Prostate cancer,
insurance coverage mandated for diagnostic screening.


         ENTITLED, An Act to  require the provision of health insurance coverage for diagnostic screening for prostate cancer.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  That chapter 58-17 be amended by adding thereto a NEW SECTION to read as follows:

     Every policy of health insurance that covers a male and that is delivered, issued for delivery, or renewed in this state, except for policies that provide coverage for specified disease or other limited benefit coverage, shall provide the following coverage for diagnostic screening for prostate cancer:

             (1)    An annual medically recognized diagnostic examination, including a digital rectal examination and a prostate-specific antigen test, as follows:

             (a)    For asymptomatic men aged fifty and over; and

             (b)    For men aged forty-five and over at high risk for prostate cancer; and

             (2)    For males of any age who have a prior history of prostate cancer, medically indicated diagnostic testing at intervals recommended by a physician, including the digital rectal examination, prostate-specific antigen test, and bone scan.

     Section  2.  That chapter 58-18 be amended by adding thereto a NEW SECTION to read as follows:

     Every group health insurance policy that covers a male and that is delivered, issued for delivery, or renewed in this state, except for policies that provide coverage for specified disease or other limited benefit coverage, shall provide the following coverage for diagnostic screening for prostate cancer:

             (1)    An annual medically recognized diagnostic examination, including a digital rectal examination and a prostate-specific antigen test, as follows:

             (a)    For asymptomatic men aged fifty and over; and

             (b)    For men aged forty-five and over at high risk for prostate cancer; and

             (2)    For males of any age who have a prior history of prostate cancer, medically indicated diagnostic testing at intervals recommended by a physician, including the digital rectal examination, prostate-specific antigen test, and bone scan.

     Section  3.  That chapter 58-18B be amended by adding thereto a NEW SECTION to read as follows:

     Every health benefit plan of a small employer carrier that covers a male and that is delivered, issued for delivery, or renewed in this state shall provide the following coverage for diagnostic screening for prostate cancer:

             (1)    An annual medically recognized diagnostic examination, including a digital rectal examination and a prostate-specific antigen test, as follows:

             (a)    For asymptomatic men aged fifty and over; and

             (b)    For men aged forty-five and over at high risk for prostate cancer; and

             (2)    For males of any age who have a prior history of prostate cancer, medically indicated diagnostic testing at intervals recommended by a physician, including the digital rectal examination, prostate-specific antigen test, and bone scan.

     Section  4.  That chapter 58-38 be amended by adding thereto a NEW SECTION to read as follows:

     Every service or indemnity-type contract issued by a nonprofit medical or surgical service plan corporation that covers a male and that is delivered, issued for delivery, or renewed in this state, except for policies that provide coverage for specified disease or other limited benefit coverage, shall provide the following coverage for diagnostic screening for prostate cancer:

             (1)    An annual medically recognized diagnostic examination, including a digital rectal examination and a prostate-specific antigen test, as follows:

             (a)    For asymptomatic men aged fifty and over; and

             (b)    For men aged forty-five and over at high risk for prostate cancer; and

             (2)    For males of any age who have a prior history of prostate cancer, medically indicated diagnostic testing at intervals recommended by a physician, including the digital rectal examination, prostate-specific antigen test, and bone scan.

     Section  5.  That chapter 58-40 be amended by adding thereto a NEW SECTION to read as follows:

     Every service or indemnity-type contract issued by a nonprofit hospital service plan or organization that covers a male and that is delivered, issued for delivery, or renewed in this state, except for policies that provide coverage for specified disease or other limited benefit coverage, shall provide the following coverage for diagnostic screening for prostate cancer:

             (1)    An annual medically recognized diagnostic examination, including a digital rectal examination and a prostate-specific antigen test, as follows:

             (a)    For asymptomatic men aged fifty and over; and

             (b)    For men aged forty-five and over at high risk for prostate cancer; and

             (2)    For males of any age who have a prior history of prostate cancer, medically indicated diagnostic testing at intervals recommended by a physician, including the digital rectal examination, prostate-specific antigen test, and bone scan.

     Section  6.  That chapter 58-41 be amended by adding thereto a NEW SECTION to read as follows:

     Every health maintenance contract that covers a male and that is delivered, issued for delivery, or renewed in this state, except for policies that provide coverage for specified disease or other limited benefit coverage, shall provide the following coverage for diagnostic screening for prostate cancer:

             (1)    An annual medically recognized diagnostic examination, including a digital rectal examination and a prostate-specific antigen test, as follows:

             (a)    For asymptomatic men aged fifty and over; and

             (b)    For men aged forty-five and over at high risk for prostate cancer; and

             (2)    For males of any age who have a prior history of prostate cancer, medically indicated diagnostic testing at intervals recommended by a physician, including the digital rectal examination, prostate-specific antigen test, and bone scan.
