Referred measure from county commission, election date set.


         ENTITLED, An Act to  permit the consolidation of certain special elections on referendum petitions with the special election on April 10, 2001, and to declare an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  If any ordinance or resolution adopted by a board of county commissioners is referred pursuant to §  7-18A-15 and if the special election on such referendum petition provided for pursuant to §  7-18A-19 falls within thirty days of April 10, 2001, the board of county commissioners may hold the special election on April 10, 2001, to coincide with the special statewide election designated by the Seventy-fifth Legislature, meeting in special session.

     Section  2.  Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
