Retailer defense to charge of selling alcoholic beverage to underage person.

         ENTITLED, An Act  authorize certain evidence in the defense of a violation for a sale of alcoholic beverages to a person under the age of twenty-one.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  That § 35-9-1.2 be amended to read as follows:

     35-9-1.2.   Any person charged with a violation of §   35-9-1 , 35-4-78, or 35-9-1.1 may offer evidence, as a defense, that he the person made a reasonable attempt to investigate the age of the person by examining an age-bearing identification document that would have appeared valid to a reasonable and prudent person.
