Health care facilities, lodging, food service or campground
establishments, licensure provisions revised.

         ENTITLED, An Act  revise certain provisions related to licensure of health care facilities and lodging and food service establishments.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  That § 34-12-10 be amended to read as follows:

     34-12-10.   All licenses Any license issued under this chapter expire expires on the next succeeding June thirtieth, unless otherwise provided by this chapter, and shall be renewed annually subject to the provisions of § §  34-12-5 and 34-12-7 and upon payment of a fee as required by §  34-12-6.

     Section  2.  That § 34-18-15 be amended to read as follows:

     34-18-15.   A license issued pursuant to §  34-18-14 shall expire on the thirtieth day of June each year , unless otherwise provided by this chapter, and shall is not be transferable from owner to owner or from location to location of the establishment or campground. Changes in ownership or location shall require the purchase of a new license which may be secured by making proper application on a form provided by the department and the payment of the proper license fee.

     Section  3.  That chapter 34-18 be amended by adding thereto a NEW SECTION to read as follows:

     The department may issue a provisional license if an applicant or licensee under this chapter fails to comply with the established standards but signifies an intention to remedy such fault. The provisional license shall state on its face the conditions under which it is granted and the period of time for which it is issued. A provisional license may also be issued to cover the maintenance of the establishment or campground until an inspection can be completed and a regular license issued, if the application for license is found to be in order.
