IN THE MATTER OF THE ADOPTION TO MANDATE SEXUAL HARASSMENT PREVENTION TRAINING FOR JUDGES TO BE ADDED TO A NEW SECTION OF SDCL CH. 16-14 JUDICIAL CONFERENCE

RULE 22-05

A hearing was held on November 9, 2021, at Pierre, South Dakota, relating to mandating sexual harassment prevention training for judges to be added to a new section to SDCL Chapter 16-14, Judicial Conference and the Court having considered the proposed adoption, oral presentation relating thereto and being fully advised in the premises, now, therefore, it is

ORDERED that the adoption to mandate sexual harassment prevention training for judges to be added to a new section to SDCL Chapter 16-14 Judicial Conference be hereby adopted to read in its entirety as follows:

Sexual Harassment Prevention Training for Judges.

Every judge or retired judge acting pursuant to an appointment by the Chief Justice shall complete sexual harassment prevention training offered by the Unified Judicial System or approved by the Chief Justice within two years after the enactment of this rule or after beginning judicial service and at least once every three years thereafter. Completion of sexual harassment prevention training approved by the State Bar will meet the requirements of this rule. Failure to complete such required training may be grounds for disciplinary action.

IT IS FURTHER ORDERED that this rule become effective February 1, 2022.
