An Act to revise provisions regarding cost reimbursement associated with medical cannabis.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That § 34-20G-27 be AMENDED:

34-20G-27. Nothing in this chapter requires:

(1) A government medical assistance program or private health insurer, workers' compensation insurance carrier, or self-insured employer providing workers' compensation benefits, to reimburse a person for costs associated with the medical use of cannabis;

(2) Any person or establishment in lawful possession of property to allow a guest, client, customer, or other visitor to smoke cannabis on or in that property; or

(3) A landlord to allow the cultivation of cannabis on the rental property.
