(Senate Bill 48)

An Act to authorize the payment of lease rental obligations to the South Dakota Health and Educational Facilities Authority, to make an appropriation therefor, and to declare an emergency.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. There is hereby appropriated from the general fund the sum of $21,669,906 to the Bureau of Finance and Management to be transferred to the South Dakota Health and Educational Facilities Authority, for purposes of paying or prepaying lease rental obligations as set forth in section 2 of this Act.

Section 2. The funds appropriated in section 1 of this Act shall be used to pay or prepay lease rental and associated fees in the amounts specified below to the South Dakota Health and Educational Facilities Authority relating to the leases between the South Dakota Health and Educational Facilities Authority and the departments or offices and the related real or personal property financed by the South Dakota Health and Educational Facilities Authority, all as described below:

(1) Lease rentals and fees in an estimated amount of $15,013,188 in connection with the lease purchase agreement between the South Dakota Health and Educational Facilities Authority and the Board of Technical Education, as successor to the South Dakota Board of Education, financed with the proceeds of a sale by the South Dakota Health and Educational Facilities Authority of series 2010A bonds; and

(2) Lease rentals and fees in an estimated amount of $6,656,718 in connection with the lease purchase agreement between the South Dakota Health and Educational Facilities Authority and the Board of Technical Education, as successor to the South Dakota Board of Education, financed with the proceeds of a sale by the South Dakota Health and Educational Facilities Authority of series 2010B bonds.

Section 3. The commissioner of the Bureau of Finance and Management shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized by this Act.

Section 4. Any amounts appropriated in this Act not lawfully expended or obligated by June 30, 2022, shall revert in accordance with the procedures prescribed in chapter 4-8.

Section 5. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
