Minimum wage increased.


         ENTITLED, An Act to  increase the minimum wage.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  That § 60-11-3 be amended to read as follows:

     60-11-3.   Every employer shall pay to each employee wages at a rate of not less than five dollars and fifteen eighty-five cents an hour. Violation of this section is a Class 2 misdemeanor.

     The provisions of this section do not apply to certain employees being paid an opportunity wage pursuant to § 60-11-4.1, babysitters, or outside salesmen.

     Section  2.  That § 60-11-3 be amended to read as follows:

     60-11-3.   Every employer shall pay to each employee wages at a rate of not less than five six dollars and fifteen fifty-five cents an hour. Violation of this section is a Class 2 misdemeanor.

     The provisions of this section do not apply to certain employees being paid an opportunity wage pursuant to § 60-11-4.1, babysitters, or outside salesmen.

     Section  3.  That § 60-11-3 be amended to read as follows:

     60-11-3.   Every employer shall pay to each employee wages at a rate of not less than five seven dollars and fifteen twenty-five cents an hour. Violation of this section is a Class 2 misdemeanor.

     The provisions of this section do not apply to certain employees being paid an opportunity wage pursuant to § 60-11-4.1, babysitters, or outside salesmen.

     Section  4.  The provisions of section 1 of this Act are effective on the date identified in a certification by the secretary of labor filed with the secretary of state and the Legislative Research Council as the effective date of the increase in the federal minimum wage under the federal Fair Labor Standards Act of 1938 or July 1, 2007, whichever is later.

     Section  5.  The provisions of section 2 of this Act are effective twelve months after the effective date of section 1 of this Act.

     Section  6.  The provisions of section 3 of this Act are effective twenty-four months after the effective date of section 1 of this Act.
