Child abuse and neglect central registry records check.


         ENTITLED, An Act to  establish certain provisions regarding the child abuse and neglect central registry.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  That chapter 26-6 be amended by adding thereto a NEW SECTION to read as follows:

     Information obtained from another state's child abuse and neglect central registry or from the national crime information databases for the purpose of conducting a background check for approval of a foster or adoptive placement may be used for purposes related to conducting the background check only and cannot be released except as authorized by law.

     Section  2.  That chapter 26-8A be amended by adding thereto a NEW SECTION to read as follows:

     Upon receipt of a written request from a governmental social service agency with child protection responsibilities for another state and a consent signed by the applicant, the Department

of Social Services shall conduct a check of the central registry for child abuse and neglect regarding a prospective foster or adoptive parent in the requesting state or any adult living in the parent's home and shall provide the results to the requesting agency.
