Board of Regents appropriation
to purchase property in Brookings County.


         ENTITLED, An Act to  make an appropriation for the purchase of certain property in Brookings County from the Department of Transportation and to declare an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  There is hereby appropriated to the Board of Regents from other funds, including indirect, royalty, and plant funds, the sum of forty-seven thousand three hundred twenty-five dollars ($ 47,325 ), or so much thereof as may be necessary, for the purchase of property from the Department of Transportation, as authorized by section 4 of chapter 96 of the 2001 Session Laws. The real property being described as follows: the East one-half of the Southwest Quarter (E 1/2 SW 1/4) of Section Thirteen (13), except Second Substation addition to the City of Brookings, and except Lot H-1 thereof, and except highway right-of-way thereof; and West one-half of the Southeast Quarter (W 1/2 SE 1/4) of Section Thirteen (13), except the West three hundred seventy- one feet (W 371') of the East five hundred forty-eight (E 548') of the South two hundred seventy- six feet (S 276') thereof and except Lot H-1 thereof, and except highway right-of-way thereof; All in Township One Hundred Ten (110) North, Range Fifty (50) West of the Fifth Prime Meridian, the South five hundred feet (S 500') of which lie within the City of Brookings, Brookings County, South Dakota; all subject to the right of the owners of the west three hundred seventy-one feet (W 371') of the East five hundred forty-eight (E 548')  of the South two hundred seventy-six feet (S 276') of the West one-half of the Southeast Quarter (W 1/2 SE 1/4) to continue with the use of the existing waterline over the East one-half of the Southwest Quarter (E 1/2 SW1/4) and the West one-half of the Southeast Quarter (W 1/2 SE1/4) thereof.

     Section  2.  Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
