Immigration and Customs Enforcement Office of Investigations
included in the definition of federal law enforcement officer.


         ENTITLED, An Act to  include officers of the Immigration and Customs Enforcement Office of Investigations in the definition of federal law enforcement officer.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  That § 23A-3-24 be amended to read as follows:

     23A-3-24.   For the purposes of § 23A-3-25, the term, federal law enforcement officer, means any officer or employee of the Federal Bureau of Investigation, the Drug Enforcement Administration, the United States Marshall Service, the Internal Revenue Service, the Secret Service, the Bureau of Alcohol, Tobacco, and Firearms, the United States Postal Inspection Service, the Federal Protective Service, and the United States Fish and Wildlife Service, and the Immigration and Customs Enforcement Office of Investigations, who is responsible for the prevention or detection of crimes or for the enforcement of the United States Code and who is authorized to arrest, with or without a warrant, any individual for a violation of the United States Code.
