Livestock contract reporting, certain provisions repealed.


         ENTITLED, An Act to  repeal certain provisions related to the reporting of livestock contracts.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

     Section  1.  That § 40-15A-1 be amended to read as follows:

     40-15A-1.   Terms used in this chapter mean:

             (1)      "Animal Industry Board" or "board," the Animal Industry Board of the State of South Dakota;

             (2)      "Licensed, accredited veterinarian," a veterinarian licensed by the state of livestock shipment origin to practice veterinary medicine within that state and accredited by the federal government for the purpose of issuing interstate certificates;

             (3)      "Livestock," cattle, sheep, horses, mules, swine, buffalo, and goats;

             (4)      "Livestock contract," a contract entered into by a person who in the ordinary course of business buys livestock produced or raised in this state or who contracts with a livestock producer to produce or raise livestock in this state if the affected livestock are acquired or contracted for at least fourteen days before slaughter;

             (5)      "Livestock dealer," any person engaged in the business of buying, selling, and dealing in livestock from producers or livestock auction markets for resale or shipment within or without the state or for resale in the local market;

             (6)      "Livestock producer," any person who produces or causes to be produced livestock in a quantity beyond the person's own family use and is able to transfer title to another or provides management, labor, machinery, facilities, or any other production input for the production of livestock;

             (7)      "Packer," any firm conducting business involved in the slaughter or processing of meat or meat products if the firm is not subject to state inspection;

             (8)      "Stocker and feeder livestock," any livestock used for feeding or breeding purposes, except feeder pigs.

     Section  2.  That § 40-15A-13 be repealed.

     Section  3.  That § 40-15A-14 be repealed.

     Section  4.  That § 40-15A-15 be repealed.

     Section  5.  That § 40-15A-16 be repealed.

     Section  6.  That § 40-15A-17 be repealed.

     Section  7.  That § 40-15A-18 be repealed.

     Section  8.  That § 40-15A-19 be repealed.
