2005 Session Laws Chapter 217

ENTITLED, An Act to make an appropriation to the state fair, to limit certain transfers and expenditures of funds, and to declare an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:

Section 1. There is hereby appropriated from the general fund the sum of six hundred fifty- three thousand nine hundred forty-four dollars ($653,944), or so much thereof as may be necessary, to the state fair for the payment of debt incurred by the state fair.

Section 2. The secretary of the Department of Agriculture shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized by this Act.

Section 3. Any amounts appropriated in this Act not lawfully expended or obligated by June 30, 2006, shall revert in accordance with § 4-8-21.

Section 4. Except for funds specifically appropriated for the state fair and the revenues received by the state fair, the Department of Agriculture may not transfer or expend any funds on the state fair from other programs or other funds within the Department of Agriculture in an amount greater than five hundred thousand dollars.

Section 5. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.
