A hearing having been held on February 10, 2003, at Pierre, South Dakota, relating to the
amendment of SDCL 16-16-16, and the Court having considered the proposed amendment, the
correspondence and oral presentations relating thereto, if any, and being fully advised in the
premises, now, therefore, it is
ORDERED that SDCL 16-16-16 be and it is hereby amended to read in its entirety as
follows:
16-16-16.
Review by Supreme Court of bar examiners' decision as to qualifications of
applicant.
If an applicant be aggrieved by the decision of the Board of Bar Examiners as to his
qualifications and shall so request, the secretary of the board shall transmit the applicant's file and
other available information to the Supreme Court for review. The court shall thereupon conduct
such investigation as it deems necessary to a decision as to the qualifications of the applicant for
admission. The decision of the court shall be communicated by the secretary to the applicant and
shall be final. Any such request for review must be filed with the court within six months thirty days
of the decision of the Board of Bar Examiners.
IT IS FURTHER ORDERED that this rule shall become effective July 1, 2003.
