ENTITLED, An Act to
clarify certain provisions concerning the residency requirements for state's
attorneys in certain small counties.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section
1.
That chapter
7-16
be amended by adding thereto a NEW SECTION to read as
follows:
In any county with a population of less than five thousand persons, no state's attorney is
disqualified from holding office for failure to be a resident of that county if the state's attorney is
a resident of a county which is contiguous to the county in which the state's attorney holds such
office.
