The four hundred thirty-ninth meeting of the Interim Rules Review Committee (IRRC) was called to order by Representative Jon Hansen, Chair, at 2:32 p.m. (CT) on March 12, 2026, in Room 413 at the State Capitol, Pierre, South Dakota.

A quorum was determined with the following members present: Representatives Jon Hansen, Chair, and Erik Muckey, and Senators Taffy Howard, Vice Chair, Liz Larson, and Jim Mehlhaff. Representative Roger DeGroot was excused. Staff members present were Justin Goetz, Code Counsel, and Kelly Thompson, Legislative Editor.

Approval of Minutes

Senator Mehlhaff moved, seconded by Representative Muckey, that the November 12, 2025, meeting minutes be approved. Motion prevailed on a unanimous voice vote of those members present (00:31.960)

Assignment of Agency Rules

A handout was provided indicating the current agency assignments for committee members. All members expressed their intention to retain their assignments from the 2025 Interim. (00:41.960)

Interim Meeting Schedule

Representative Hansen explained that the committee usually meets on Tuesdays. Meetings begin at 10:00 a.m. (CT) unless the length of the agenda necessitates an earlier start time, and are usually held in Room 414 of the State Capitol, with remote participation available via Microsoft Teams. Upon reviewing a list of potential meeting dates, members set the following meeting schedule for the 2026 Interim: April 21, May 5, June 9, July 14, August 18, September 8, and October 12. Service of Rules (Electronic vs. Hard Copy)

Committee members may receive rules documents from agencies electronically, in hard copy form, or by both means. For the 2026 Interim, all members requested to receive both electronic and hard copy service with the exception of Senators Larson and Mehlhaff who opted to receive electronic service only. LRC staff will update Form 12 and Form E-3 accordingly, notify agency rules contacts, and post the information on the LRC website. (06:03.700)

Staff Report

Mr. Justin Goetz, Code Counsel, advised committee members that at least fifty bills were introduced during the 2026 Legislative Session related to rulemaking authority, whether adding, revising existing, or repealing the authority. Of these, twenty have passed both chambers. The two interim committee bills adopted by the committee - Senate Bill 56 and Senate Bill 57 - have been signed by the Governor and shall become law on July 1, 2026.

Also signed by the Governor and substantially impacting the chapter 1-26 rulemaking process is Senate Bill 133. The bill creates a new filing for all rules - the regulatory impact analysis - and expands the actions the committee can take if a rule packet constitutes a major rule.

Mr. Goetz reported that, to date, six rule packets have been received for consideration during the 2026 Interim. (07:02.820)
