The four hundred thirtieth meeting of the Interim Rules Review Committee (IRRC) was called to order by Representative Jon Hansen, Vice Chair, at 12:06 p.m. (CT) on March 3, 2025, in Room 413 at the State Capitol, Pierre, South Dakota.

A quorum was determined with the following members present: Representatives Jon Hansen, Vice Chair, Roger DeGroot, and Erik Muckey, and Senator Taffy Howard. Senators Liz Larson and Jim Mehlhaff were excused. Staff members present were Justin Goetz, Code Counsel, and Kelly Thompson, Legislative Editor.

Approval of Minutes

Representative DeGroot moved, seconded by Senator Howard, that the October 22, 2024, meeting minutes be approved. Motion prevailed on a unanimous voice vote of those members present.

Selection of Chair and Vice Chair

Representative Hansen advised members that when elected, the practice is that the Chair and Vice Chair serve for two-year terms, with one position being a member from the Senate and one being from the House of Representatives. The Chair position alternates between chambers each term.

Representative DeGroot moved, seconded by Senator Howard, that Representative Hansen be named as Chair for the 2025-2026 Interims. Motion prevailed on a roll call vote with 4 AYES and 2 EXCUSED. Voting AYE: DeGroot, Hansen, Howard, and Muckey. EXCUSED: Larson and Mehlhaff.

Representative Muckey moved, seconded by Representative DeGroot, that Senator Howard be named as Vice Chair for the 2025-2026 Interims. Motion prevailed on a roll call vote with 4 AYES and 2 EXCUSED. Voting AYE: DeGroot, Hansen, Howard, and Muckey. EXCUSED: Larson and Mehlhaff.

Assignment of Agency Rules

A handout was provided indicating the current agency assignments for returning committee members and the available assignments for first term members. Representatives DeGroot and Hansen, and Senator Mehlhaff will retain their current assignments for the 2025 Interim. Senator Howard will assume those agencies previously assigned to Representative Healy, Senator Larson will take over Senator Foster's agencies, and Representative Muckey will represent those agencies previously assigned to Senator Hunhoff.

Interim Meeting Schedule

Representative Hansen explained that the committee usually meets on Mondays or Tuesdays to allow members who are on other interim committees to attend multiple meetings on a single trip, when possible. All meetings begin at 10:00 a.m. (CT) unless the length of the agenda necessitates an earlier start time and are usually held in Room 414 of the State Capitol, with remote participation available via Microsoft Teams.

Senator Howard moved, seconded by Representative Muckey, that the Interim Rules Review Committee set the following meeting schedule for the 2025 Interim: April 8, May 6, June 10, July 15, August 19, September 9, and October 7. Motion prevailed on a roll call vote with 4 AYES and 2 EXCUSED. Voting AYE: DeGroot, Hansen, Howard, and Muckey. EXCUSED: Larson and Mehlhaff.

Service of Rules (Electronic vs. Hard Copy)

Committee members may receive rules documents from agencies electronically, in hard copy form, or by both means. For the 2025 Interim, all members requested to receive both electronic and hard copy service with the exception of Senator Mehlhaff who will continue to receive electronic service only. LRC staff will update Form 12 and Form E-3 accordingly, notify agency rules contacts, and post the information on the LRC website.

Staff Report

Mr. Justin Goetz, Code Counsel, outlined the role of LRC staff in relation to the Interim Rules Review Committee, saying they serve as a resource to committee members and offering his assistance with any member questions or concerns. He advised the committee that he will provide staff memos prior to each meeting with information regarding each rules packet to be heard at that scheduled meeting as well as make periodic reports regarding technical corrections made to rules and provide updates on changes in the process and forms. A memo was provided detailing committee responsibilities and bills of interest from the 2025 Legislative Session.

Mr. Goetz reported that, to date, five rules packets have been received for consideration during the 2025 Interim.

Representative Muckey moved, seconded by Senator Howard, that the meeting be adjourned. Motion prevailed on a unanimous voice vote of those members in attendance.

Chair Hansen adjourned the meeting at 12:18 p.m. (CT).
