        FOR AN ACT ENTITLED, An Act to provide for the sale of the state's interests in certain real estate and improvements located at the Human Services Center campus.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. The Department of Social Services may sell the state's interest in the real estate and any related personal property and improvements commonly known as the Mead Building located on the Human Services Center campus, Yankton County, South Dakota, to the Yankton County Historical Society, Inc., upon expiration or early termination of the lease dated July 25, 2012, between the department and the Yankton County Historical Society, Inc., which lease is hereby ratified. The sale may be made if the department determines that the improvements described in the lease have been made as described in the lease, and that the Mead Building is ready for occupancy. If the department determines to sell the property, the Yankton County Historical Society, Inc. shall be given credit against the purchase price for any increase in the fair market value of the property resulting from improvements that have been made by the Yankton County Historical Society, Inc., at its expense, up to the fair market value of the

property at the time of the sale. Upon sale of the property, the department shall provide the purchaser access to the real estate on Human Services Center roads.
    Section 2. The proceeds from the sale of the real estate and improvements shall be deposited in the permanent fund established by S.D. Const., Art. VIII, § 7 for the use and benefit of the Human Services Center.
    Section 3. Upon the department's determination to sell the property as described in section 1 of this Act, the Governor shall execute a quitclaim deed which shall be attested by the Commissioner of School and Public Lands, to transfer all of the state's right, title, and interest in the real estate and improvements commonly known as the Mead Building, containing approximately 1.24 acres of real property located in Tract 1, Lot A, SE 1/4, Section 36, Township 94 North, Range 56 West of the 5th P.M. in Yankton County, South Dakota, as described on the plat to be recorded in the Yankton County Register of Deeds Office, to the Yankton County Historical Society, Inc., subject to all applicable statutory and constitutional reservations.
