FOR AN ACT ENTITLED, An Act to reestablish the crime of rustling and to provide a penalty
therefor.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 22-30A be amended by adding thereto a NEW SECTION to read
as follows:
The theft of any cattle, horses, mules, sheep, goats, buffalo, or captive nondomestic elk is
rustling. Rustling is a Class 4 felony.
Section 2. That § 22-30A-17 be amended to read as follows:
22-30A-17. Theft is grand theft, if the property stolen:
(1) Exceeds one thousand dollars in value;
(2) Is a firearm;
(3) Is taken from the person of another; or
(4) The property stolen is cattle, horses, mules, buffalo, or captive nondomestic elk.
Grand theft is a Class 4 felony.
