FOR AN ACT ENTITLED, An Act to prohibit certain political activity within the Office of the
Secretary of State.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. Neither the secretary of state nor any deputy or employee whose duties within the
Office of the Secretary of State involves, to any degree, the supervision or administration of any
statewide election or any state legislative election may:
(1) Endorse any candidate for election to congressional, state, or legislative office; or
(2) Work for, volunteer for, or otherwise assist any candidate for election to
congressional, state, or legislative office; or
(3) Advise or consult with any candidate for election to congressional, state, or
legislative office.
Any person who violates any provision of this Act shall resign or shall be terminated
forthwith. In the absence of resignation or termination, any person aggrieved by a violation of
this Act is entitled to an expedited hearing before the circuit court of Hughes County, which
court shall have plenary powers to enforce the provisions of this Act.
