FOR AN ACT ENTITLED, An Act to deposit money in the permanent school fund based on
certain acres of school and public lands open to public hunting.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 41-2 be amended by adding thereto a NEW SECTION to read as
follows:
Beginning in 2014 and each year thereafter, and except as provided in this section, for each
acre of school and public lands that is shown on any hunting atlas, map, or other publication or
document that is made available to the public by the Department of Game, Fish and Parks, or
any other state agency, as open to public hunting during the calendar year, money shall be
transferred from the Department of Game, Fish and Parks fund to the permanent school fund
established pursuant to S.D. Const., Art. VIII, § 2. The amount of money transferred for each
such acre shall be equal to the average amount paid per acre in each respective county during
the previous calendar year to landowners under the walk-in area program and any other state
program established for the purpose of providing free public hunting access on private lands and
funded through the surcharge established in § 41-2-34.2. If the department chooses not to
transfer money from the Department of Game, Fish and Parks fund to the permanent school
fund under the provisions of this section, the location of any school and public lands that are
open to public hunting may not be shown or designated as open to public hunting on any such
hunting atlas, map, publication, or document.
