FOR AN ACT ENTITLED, An Act to revise certain provisions relating to the failure to fulfill
the responsibilities of jury duty.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 16-13-45 be amended to read as follows:
16-13-45. If any person summoned to appear as a grand juror or petit juror fails, refuses, or
neglects to appear, or willfully fails to complete and return the jury questionnaire,
or if having
fails to attend as required by the court, such person
shall be considered is
guilty of contempt of the court and may be fined by the court in any sum not less than
nor more than
fifty five hundred
; and if. If
any person, when a second order of
attachment is issued, neglects or refuses to appear, such person may be fined as above provided
and imprisoned by the court not longer than ten days in the county jail.
