        FOR AN ACT ENTITLED, An Act to allow student midwives to practice the functions of a nurse practitioner or nurse midwife in certain instances.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That § 36-9A-3 be amended to read as follows:
    36-9A-3. This chapter does not prohibit the performance of the functions of a nurse practitioner or nurse midwife by an unlicensed person if performed:
            (1)    In an emergency situation;
            (2)    By a legally qualified person from another state employed by the United States government and performing the person's official duties in this state;
            (3)    By a person enrolled in an approved program for the preparation of nurse practitioners or nurse midwives, as a part of that approved program; or
            (4)    By a certified professional midwife student during clinical training and under the direct supervision of a preceptor who has met the preceptor criteria established by the North American Registry of Midwives and is licensed in South Dakota under chapter

36-9A or chapter 36-4.
