FOR AN ACT ENTITLED, An Act to repeal certain outdated and obsolete provisions regarding
the Bureau of Information and Telecommunications.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That § 1-33-34 be repealed.
1-33-34. The bureau shall prepare, or cause to be prepared, an action plan and budget
detailing the goals and objective identified by the bureau for a five-year period and shall submit
such action plan and any amendments thereto to the commissioner of information and
telecommunications by July first of each year.
Section 2. That § 1-33-52 be repealed.
1-33-52. The Bureau of Information and Telecommunications may contract for the lease or
lease/purchase of information processing equipment for state agencies. Such contracts may not
exceed five years.
Section 3. That § 1-33-56 be repealed.
1-33-56. The Legislature hereby declares that it is in the interest of the state to enter into an
agreement to purchase a central processing unit for the state computer system. The Bureau of
Information and Telecommunications is hereby authorized to enter into an agreement to
purchase on a sixty-month basis a central processing unit to provide the state with needed
computer capacity.
The data processing internal service fund established in the treasury is hereby divided into
an administrative account and an equipment reserve replacement account. The fee schedule for
the use of the equipment mentioned above shall be designed to the extent practicable to recover
cost as if the equipment were under a regular lease agreement. The difference between such
costs and the amount necessary to pay the purchase agreement shall be established in the
equipment reserve replacement account to be used at a future date.
