An Act to revise certain provisions regarding the abuse of health insurance.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That § 58-17-60 be AMENDED.

58-17-60. Certain payments exempt.

Payments made pursuant to federal medicare laws or payments made to the health-care a health care provider according to a contract or agreement between an employer and employee which that requires a third‑party payor to pay the full amount for health-care health care services are exempt from §§ 58-17-57 to 58-17-60, inclusive. Payments by a person to a health care provider for services that are not processed as a claim by a third-party payor are exempt from §§ 58-17-57 to 58-17-60, inclusive, and may count towards a deductible or co-payment in the person's health benefit plan. A third-party payor may not prohibit a health care provider from, nor penalize a health care provider for, providing consumers with information on cost sharing or cash prices for services.
