FOR AN ACT ENTITLED, An Act to make appropriations for the purpose of one-time
increases in education and health care funding.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. There is hereby appropriated from the general fund the sum of three million nine
hundred thirty-seven thousand two hundred eighty-two dollars ($3,937,282), or so much thereof
as may be necessary, to the Department of Education for the purpose of a one-time payment to
school districts.
Section 2. The secretary of the Department of Education shall distribute the funds
appropriated by section 1 of this Act, on a one-time basis, to school districts based on fall
enrollment as defined in subdivision 13-13-10.1(2A) at the same time that foundation program
state aid is distributed to school districts pursuant to §§ 13-13-10.1 to 13-13-41, inclusive.
Section 3. There is hereby appropriated from the general fund the sum of eight million four
hundred thirty-seven thousand thirty-one dollars ($8,437,031), or so much thereof as may be
necessary, to the Department of Education for the purpose of providing one-time training and
support to teachers and school leaders.
Section 4. There is hereby appropriated from the general fund the sum of four hundred
thirteen thousand eight hundred forty-nine dollars ($413,849), or so much thereof as may be
necessary, to the Department of Education for the purpose of a one-time payment to
postsecondary technical institutes pursuant to ARSD 24:10:42:28.
Section 5. There is hereby appropriated the sum of thirty-five thousand four hundred ninety
dollars ($35,490), or so much thereof as may be necessary, in federal fund expenditure authority
to the Department of Education for the purpose of a one-year temporary service rate increase
for providers.
Section 6. There is hereby appropriated from the general fund the sum of seven million eight
hundred eighty-six thousand seven hundred fourteen dollars ($7,886,714), the sum of nine
million six hundred forty-eight thousand five hundred eighty-one dollars ($9,648,581) in federal
fund expenditure authority, and the sum of five thousand seven hundred fifty-seven dollars
($5,757) in other fund expenditure authority, or so much thereof as may be necessary, to the
Department of Social Services for the purpose of a one-year temporary service rate increase for
providers.
Section 7. There is hereby appropriated from the general fund the sum of nine hundred
ninety-one thousand seven hundred twenty dollars ($991,720), and the sum of one million two
hundred twenty-four thousand one hundred seventy-six dollars ($1,224,176) in federal fund
expenditure authority, or so much thereof as may be necessary, to the Department of Human
Services for the purpose of a one-year temporary service rate increase for providers.
Section 8. There is hereby appropriated from the general fund the sum of one hundred
eighty-seven thousand seven hundred sixty-eight dollars ($187,768), and the sum of one
hundred forty-five thousand nine hundred sixty-nine dollars ($145,969) in federal fund
expenditure authority, or so much thereof as may be necessary, to the Department of Corrections
for the purpose of a one-year temporary service rate increase for providers.
Section 9. There is hereby appropriated from the general fund the sum of twenty-nine
thousand five hundred eighty-eight dollars ($29,588), or so much thereof as may be necessary,
to the Unified Judicial System for the purpose of a one-year temporary service rate increase for
providers.
Section 10. There is hereby appropriated from the general fund the sum of five million nine
hundred twenty-two thousand one hundred fifty-eight dollars ($5,922,158), or so much thereof
as may be necessary, to the Board of Regents for the purpose of a one-time payment to the
regental system.
Section 11. The Governor shall approve vouchers for sections 1 to 8, inclusive, of this Act,
the Chief Justice shall approve vouchers for section 9 of this Act, the Executive Director of the
Board of Regents shall approve vouchers for section 10 of this Act, and the state auditor shall
draw warrants to pay expenditures authorized by this Act.
Section 12. The sum of twenty-seven million eight hundred six thousand one hundred ten
dollars ($27,806,110) in the general fund on June 30, 2012, shall be obligated and committed
for the purposes of the appropriations made by this Act. The provisions of §§ 4-7-32 and 4-7-39
do not apply to these funds.
Section 13. Section 12 of this Act is effective June 20, 2012.
Section 14. Any amounts appropriated in this Act not lawfully expended or obligated shall
revert in accordance with the procedures prescribed in § 4-8-21.
