        FOR AN ACT ENTITLED, An Act to prohibit hiring discrimination on the basis of current employment status.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That chapter 20-13 be amended by adding thereto a NEW SECTION to read as follows:
    It is an unfair or discriminatory practice for any person or business to fail or refuse to hire a person based on the person's current employment status. It is an unfair discriminatory practice for any person or business to include an employment status requirement in a job advertisement or to otherwise require, directly or indirectly, a person to have a specific employment status to apply for a job.
