        FOR AN ACT ENTITLED, An Act to prohibit political contributions by certain state employees to gubernatorial candidates.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. No person, who is a full-time employee of any executive department, agency, or subdivision, subject to the direct or indirect supervision and control of the Governor, may make any contribution, as defined in subdivision 12-27-1(6), to any gubernatorial candidate or to any political action committee organized primarily for the support of any gubernatorial candidate. The provisions of this section apply regardless of the gubernatorial candidate's incumbency or nonincumbency and regardless of the gubernatorial candidate's political affiliation.
    Section 2. Any person who violates the provisions of section 1 of this Act is disqualified from retaining employment as a full-time state employee in any department, agency, or subdivision, subject to the direct or indirect supervision of the Governor, or from receiving employment as a full-time state employee in any department, agency, or subdivision, subject to the direct or indirect supervision of the Governor. This disqualification applies regardless of whether the gubernatorial candidate elected was or was not the gubernatorial candidate that the

person supported in violation of section 1 of this Act.
