FOR AN ACT ENTITLED, An Act to require the state to provide the public with access to an
electronic database containing certain information on any loans, grants, or tax rebates
provided by the state for the purpose of economic development.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
Section 1. That chapter 1-27 be amended by adding thereto a NEW SECTION to read as
follows:
The state shall provide to the public, on the searchable internet website created pursuant to
§ 1-27-45, access to an electronic database highlighting the state's investment in economic
development. For any entity that receives a loan, grant, tax rebate, or credit from the state for
the purpose of economic development through any state program or from any state department
or board, including the Board of Regents, the database shall include the following information:
(1) The name of the entity that received the loan, grant, tax rebate or credit;
(2) The type of loan, grant, tax rebate, or credit received by each entity;
(3) The amount of the loan, grant, tax rebate, or credit that each entity received, and the
date on which it was received; and
(4) If applicable, the number of jobs projected to be created or retained by the entity as
a result of the loan or grant.
The Bureau of Information and Telecommunications shall maintain the database, and update
it at least quarterly.
Section 2. That chapter 1-52 be amended by adding thereto a NEW SECTION to read as
follows:
The information provided to the public pursuant to this Act is not confidential and not
subject to the provisions of §§ 1-16B-14.1, 1-16G-11, 1-27-1.5, 1-52-3.4, and 1-52-13.
Section 3. That chapter 1-33 be amended by adding thereto a NEW SECTION to read as
follows:
The commissioner of the Bureau of Information and Telecommunications shall promulgate
rules pursuant to chapter 1-26 to establish procedures for the timely collection of the data
required pursuant to this Act from the applicable state departments and boards.
