        FOR AN ACT ENTITLED, An Act to authorize the carryover of the state aid to special education appropriation in order to meet federal maintenance of effort levels.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That chapter 13-37 be amended by adding thereto a NEW SECTION to read as follows:
    Notwithstanding the provisions of §§ 4-8-19, 13-37-40, and 13-37-45 for fiscal year 2012 and each year thereafter, any unencumbered funds appropriated from the state general fund for state aid to special education, may be carried forward to the following fiscal year to meet the federal maintenance of effort requirement for special education funding.
    Section 2. This Act is effective June 20, 2012.
