        FOR AN ACT ENTITLED, An Act to revise certain requirements pertaining to earnest money paid in a cooperative or cobrokerage real estate transaction.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF SOUTH DAKOTA:
    Section 1. That § 36-21A-76 be amended to read as follows:
    36-21A-76. Any earnest money paid in a cooperative or cobrokerage transaction shall be held in the listing a broker's trust account unless otherwise agreed to by the buyer and seller.
