SECOND READING OF SENATE BILLS AND JOINT RESOLUTIONS


     SB 133:   FOR AN ACT ENTITLED, An Act to   revise the distribution of revenue from the petroleum release compensation and tank inspection fee.

     Was read the second time.

     Rep. Jaspers moved that SB 133 be amended as follows:

     On the House State Affairs Committee engrossed bill, delete House amendments, thus restoring the bill to the Senate Taxation Committee engrossed version.

     On page 2 , line 14, overstrike " Beginning in fiscal year 2000 to December 31, 2002, " and insert " Beginning in April 1, 2002, to December 31, 2002, inclusive, ten and nine tenths percent shall be deposited in the petroleum release compensation fund and thirty-nine and one-tenth percent shall be deposited in the state highway fund. ".

     On page 2 , overstrike line 15 .

     On page 2 , line 24, after " dollars. " insert " An ethanol production facility is eligible for a production incentive payment under this section only if the facility has produced qualifying ethyl alcohol on or before December 31, 2006. ".

     On page 3 , line 4, delete " seven million dollars " and insert " four million dollars for fiscal year 2003, five million dollars for fiscal year 2004, six million dollars for fiscal year 2005, and seven million dollars thereafter ".

     On page 3 , after line 14, insert:

"      Section 4. That § 5-27-5 be amended to read as follows:

     5-27-5.   During fiscal year 1999, the Bureau of Finance and Management shall transfer each month three and six-tenths percent of the monthly state capital construction fund revenues from the state capital construction fund to the public and special transportation fund. Beginning in

fiscal year 2000 to December 31, 2002, inclusive, the Bureau of Finance and Management shall transfer each month three and one-half percent of the monthly state capital construction fund revenues from the state capital construction fund to the public and special transportation fund. Beginning on January 1, 2003, the Bureau of Finance and Management shall transfer each month two and six-tenths percent of the monthly state capital construction fund revenues from the state capital construction fund to the public and special transportation state highway fund.

     Section 5. On or about April 1, 2002, the state treasurer shall transfer the sum of fifteen million dollars ($15,000,000) from the petroleum release compensation fund to the state highway fund.

     Section 6. Whereas, this Act is necessary for the support of the state government and its existing public institutions, an emergency is hereby declared to exist, and this Act shall be in full force and effect from and after its passage and approval.".

"      Section 4. That chapter 10-47B be amended by adding thereto a NEW SECTION to read as follows:

     Each ethanol producer that receives any production incentive payment shall submit to the Department of Legislative Audit an annual financial statement prepared by an independent certified public accountant before March first of each year for the preceding twelve months. The financial statement shall be prepared in accordance with generally accepted accounting principles and shall be unqualified and without limitations by the accountant. The Department of Legislative Audit shall annually review the financial records of each ethanol producer that receives any production incentive payment from the ethanol fuel fund and shall report such findings to the Legislature. The financial records and information collected by the department and reported to the Legislature are not considered public records and are exempt from disclosure. If the annual gross profit exceeds a return of fifteen percent on the tangible net worth

of the facility, the ethanol producer shall return all of the production incentive payment received in the previous fiscal year to the state. If the annual gross profit on the tangible net worth of the facility is ten to fifteen percent, inclusive, the ethanol producer shall return one-half of the production incentive payment received in the previous fiscal year to the state. Such return shall be made within ninety days of notification by the department. From the date that an ethanol producer's profit exceeds the threshold for return of one-half of the production incentive payment as provided in this section, the producer may never again in any year receive more than one-half of the production incentive payment to which the producer would have otherwise been entitled for that year. From the date that an ethanol producer's profit exceeds the threshold for return of all of the production incentive payment as provided in this section, the producer is no longer eligible for any future production incentive payment, and all such payments to the producer shall cease.".
