     The prayer was offered by the Chaplain, Pastor Howard Grinager, followed by the Pledge of Allegiance led by House page Lakota Mowrer.

     Section 5. Serious detriment to a child exists whenever there is proof of one or more of the following extraordinary circumstances:

             (1)    The abandonment or persistent neglect of the child by the parent;

             (2)    The likelihood of serious physical or emotional harm to the child if placed in the parent's custody;

             (3)    The extended, unjustifiable absence of parental custody;

             (4)    The abdication of parental responsibilities;

             (5)    The provision of the child's physical, emotional, and other needs by persons other than the parent over a significant period of time;

             (6)    The existence of a bonded relationship between the child and the person other than the parent sufficient to cause significant emotional harm to the child in the event of a change in custody;

             (7)    The substantial enhancement of the child's well-being while under the care of the person other than the parent;

             (8)    The extent of the parent's delay in seeking to reacquire custody of the child;

             (9)    The demonstrated quality of the parent's commitment to raising the child;

             (10)    The likely degree of stability and security in the child's future with the parent;

             (11)    The extent to which the child's right to an education would be impaired while in the custody of the parent; or

             (12)    Any other circumstances that would substantially and adversely impact the welfare of the child.".

     On the Senate Health and Human Services Committee engrossed bill, delete everything after the enacting clause and insert:

"      Section 1. That chapter 34-14 be amended by adding thereto a NEW SECTION to read as follows:

     If a genetic test, as defined in § 34-14-21, is required or authorized by state law, or performed in the state, the test shall be performed in a laboratory accredited by the College of American Pathologists, the Joint Commission on Accreditation of Healthcare Organizations, or any accreditation body approved by the United States Secretary of Health and Human Services and which has requirements that are substantially equivalent to, or more comprehensive than, those of the College of American Pathologists. In addition, the laboratory shall be enrolled in a proficiency testing program sponsored by an organization approved by the Centers for Medicare and Medicaid Services. Nothing in this section alters the ability of the state health laboratory to perform genetic tests.

     Section 2. That § 34-14-24 be amended to read as follows:

     34-14-24.   Nothing in § §   34-14-21 to 34-14-24, inclusive, or section 1 of this Act, alters the ability to perform genetic tests done in pursuance of a lawful criminal investigation or court order. "


     And that as so amended said bill do pass and be placed on the Consent Calendar.

     WHEREAS,  the current mission statement of the Department of Corrections does not include the goal of inmate rehabilitation; and

     WHEREAS,  in the year 2001, the Department of Corrections returned 1,551 adult inmates to our communities; and

     WHEREAS,  we, as the State Legislature, encourage all citizens to be useful, employable, well adjusted, and socially acceptable individuals:
     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- seventh Legislature of the State of South Dakota, the Senate concurring therein, that the Department of Corrections be strongly encouraged to modify their mission statement to include the following statements: "The mission of the Department of Corrections is to provide the highest level of social rehabilitation, correctional treatment, medical care and related treatment to persons committed to the correctional institutions that will assist those committed in achieving or maintaining economic self-support or self-sufficiency that will reduce dependency; to provide needed long-term care services to those permanently admitted or committed; to assure that those released are useful, employable, well adjusted, and socially acceptable individuals and to insure against a return to the institutional environment; and to insure that the conditions of confinement in local correctional facilities provide decent and humane care to detainees in order to expedite their successful return to their community."

     WHEREAS,  the National Motto of the United States of America is In God We Trust; and

     WHEREAS,  the National Motto was adopted in 1956 and is codified at 36 U.S.C.A. §  302; and

     WHEREAS,  the National Motto reflects the traditional sentiment that we are a religious people whose institutions presuppose a Supreme Being; and

     WHEREAS,  the sentiment In God We Trust is deeply interwoven into the fabric of our civil polity; and

     WHEREAS,  the sentiment of the National Motto is as the Republic itself, and has always been as integral a part of the First Amendment to the United States Constitution as the very words of that charter of religious liberty; and

     WHEREAS,  that the Founding Fathers believed devotedly that there was a God, and that the unalienable rights of man were rooted in Him, is clearly evidenced in their writings, from the Mayflower Compact to the United States Constitution itself; and

     WHEREAS,  our national and state life reflects a religious people who earnestly pray that the Supreme Lawgiver guide them in every measure which may be worthy of His blessing; and

     WHEREAS,  the National Motto serves the secular purpose of expressing confidence in the future and encouraging the recognition of what is worthy of appreciation in society; and

     WHEREAS,  the National Motto appears on all coins and paper currency issued by the United States government; and

     WHEREAS,  the words, In God We Trust, are over the entrance to the United States Senate Chamber and are prominently engraved in the wall above the Speaker's dias in the chamber of the United States House of Representatives; and

     WHEREAS,  on July 24, 2000, the United States of America, acting by and through Congress assembled, did unanimously resolve to affirm its support for the National Motto and to support and encourage the display of the National Motto in all public buildings and public schools:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- seventh Legislature of the State of South Dakota, the Senate concurring therein, that the Legislature of the State of South Dakota supports and encourages the public display of the National Motto in all public buildings, public schools, and other government institutions established or maintained at taxpayer expense within the state and declares its support for the National Motto.

         A LEGISLATIVE COMMEMORATION,  Honoring United Nations Ambassador and former United States Senator George McGovern for service to South Dakota and the United States.

     WHEREAS,  George McGovern, a native son of South Dakota, was born in Avon on July 19, 1922, grew up in Mitchell, was educated and taught at Dakota Wesleyan University, and has returned to South Dakota to live in Mitchell with his wife Eleanor; and

     WHEREAS,  George McGovern served South Dakota with honor and distinction in the United States Congress as a United States Representative from 1957 to 1960 and as a United States Senator from 1963 to 1981; and

     WHEREAS,  George McGovern, a decorated World War II veteran, has served as a United State's Ambassador to the United Nation's World Food Hunger Program and was recently appointed a United Nation's Ambassador on World Hunger; and

     WHEREAS,  George McGovern is one of the great humanitarians of our time and throughout his years of selfless public service has always remained mindful of and dedicated to his home state of South Dakota:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Seventy-seventh Legislature of the State of South Dakota, that Ambassador George McGovern be honored for his many years of distinguished public service to the people of South Dakota, the United States of America, and the international community of nations.
