     The Senate convened at 11:00 a.m., pursuant to adjournment, the President presiding.

     The prayer was offered by the Chaplain, Rev. Paul Bly, followed by the Pledge of Allegiance led by Senate page Caitlin Forman.

APPROVAL OF THE JOURNAL

MR. PRESIDENT:

     The Committee on Legislative Procedure respectfully reports that the Secretary of the Senate has had under consideration the Senate Journal of the thirty-eighth day.

     All errors, typographical or otherwise, are duly marked in the temporary journal for correction.

REPORTS OF CONFERENCE COMMITTEES


MR. PRESIDENT:

     The Conference Committee respectfully reports that it has considered SB 42 and the amendments thereto made by the House, and the disagreement of the two houses thereon, and recommends that SB 42 be amended as follows:

     On page 1, after line 14 of the House engrossed bill, insert:

    "Section 2. That chapter 10-59 be amended by adding thereto a NEW SECTION to read as follows:

     Any claim for refund by a taxpayer that is based upon or arose because of the South Dakota Supreme Court's decision in In the Matter of the Sales Tax Liability of James Pirmantgen & Patricia Carlson, 2008 SD 127 (December 23, 2008), must be filed with the owner of a mini- storage or self-storage facility on or before September 15, 2009. Each owner of a mini-storage or self-storage facility is immune from any sales tax liability to the taxpayer after September 15, 2009. However, if any sales taxes is refunded by the Department of Revenue and Regulation to the owner, the owner is not immune until the owner has refunded the sales taxes to the taxpayer."

     HB 1153: FOR AN ACT ENTITLED, An Act to  revise the elements of the crime of indecent exposure involving a child, to revise the elements of the crime of indecent exposure, and to establish the crime of private indecent exposure.

     HB 1237: FOR AN ACT ENTITLED, An Act to  make an appropriation to fund certain property and sales tax refunds for elderly persons and persons living with a disability, to make an appropriation to fund sales tax on food refunds, and to revise the eligibility requirements for the sales tax on food refund program.

     HB 1254: FOR AN ACT ENTITLED, An Act to  exclude any federal stimulus funds in a school district's general fund when determining its allowable general fund balance.
