     "Section 1. That section 3 of chapter 205 of the 2000 Session Laws be amended to read as follows:

     Section 3. That § 41-6-18.4 be amended to read as follows:

     41-6-18.4.   The Game, Fish and Parks Commission may promulgate rules in accordance with chapter 1-26 to authorize the department to issue up to two thousand fall three-day temporary nonresident waterfowl licenses, up to two thousand early fall Canada goose temporary nonresident licenses, and a number of spring snow goose temporary nonresident licenses to be determined by the department, and to establish the fee therefor, validity of the licenses issued, types of waterfowl to be hunted, and areas in which hunting is permitted. The Up to five hundred of the fall three-day temporary nonresident waterfowl licenses shall be made available for use in the counties of Brown, Marshall, Roberts, Day, Grant, Clark, Codington, Deuel, and Hamlin. The commission, in rules promulgated pursuant to chapter 1-26, may establish a

process and criteria to allow the issuance of a portion of the five hundred licenses in counties other than those specified if the department determines that such licenses are otherwise likely to remain unsold. Except for the fall three-day temporary nonresident waterfowl licenses issued in Brown, Marshall, Roberts, Day, Grant, Clark, Codington, Deuel, and Hamlin counties, the fall three-day temporary nonresident waterfowl licenses are valid only on private property, but are not valid on private property leased by the department for public hunting or on highways or other public rights-of-way within this state that otherwise meet the requirements of §   41-9-1.3. Revenue from the sale of fall three-day temporary nonresident waterfowl licenses shall be deposited in the department's land acquisition and development fund to be used to acquire, by lease, permit, or otherwise, interests in real property to be used for providing waterfowl hunting public access in the counties adjacent to the Missouri River. Revenue from the sale of early fall Canada goose temporary nonresident licenses shall be deposited in the department's land acquisition and development fund to be used to acquire by lease, permit, or otherwise, interests in real property to be used for providing waterfowl hunting public access. Before promulgating rules which permit the issuance of fall three-day temporary nonresident waterfowl licenses, the commission shall determine that adequate waterfowl hunting public access has been provided through the department's land acquisition and development fund or through other means.

     Section 2. The amendment under this Act to section 3 of chapter 205 of the 2000 Session Laws is repealed on June 30, 2003."

         A CONCURRENT RESOLUTION,  Supporting adequate funding for vocational-technical education programs in South Dakota.

     WHEREAS,  the 1995 Legislature enacted a new method of distributing general state aid to school districts and this new method changed support for secondary education programs; and

     WHEREAS,  secondary vocational-technical education programs are a critical link to community and state workforce development goals; and

     WHEREAS,  a well-educated and skilled workforce is vital to the economic development of local communities and the state of South Dakota; and

     WHEREAS,  fiscal challenges can cause individual school districts to reduce or eliminate funding for certain vocational-technical programs due to the high costs sometimes associated with the special equipment and facilities they require; and

     WHEREAS,  a significant number of high school graduates go directly into articulated postsecondary education or employment opportunities:

     NOW, THEREFORE, BE IT RESOLVED,  by the Senate of the Seventy-seventh Legislature of the State of South Dakota, the House of Representatives concurring therein, that the South Dakota Legislature supports the adequate funding of approved secondary vocational-technical education programs.

     HB 1106:   FOR AN ACT ENTITLED, An Act to   revise certain provisions regarding the confidential nature of peer review activities of physicians.

     Sen. Bogue moved that HB 1106 be amended as follows:

     On page 2, after line 5 of the printed bill, insert:

     "Section 2. The provisions of §  36-4-26.1 do not apply:

             (1)    To the extent that any person identified in §  36-4-42 who conducted or caused to be conducted the peer review expressly waives the privilege by so stating its intent in writing; or

             (2)    To the extent that, in a civil, administrative, or similar case or proceeding, the court or hearing officer determines that the provisions of §  36-4-26.1 are asserted for a fraudulent purpose. However, the court or hearing officer shall review the communication in camera before making such a determination.

     A party seeking disclosure under subdivision (2) of this section has the burden of proving a fraudulent purpose.

     Section 3. In ordering disclosure under section 2 of this Act, the court or hearing officer may only compel the disclosure of communications that are relevant to the issues in dispute in the underlying proceeding. A party unsuccessfully opposing disclosure may apply for an appropriate order protecting the communication from further disclosure. There is an immediate right of appeal of any order under this section.

     Section 4. Section 36-4-26.1 does not extend to any of the following:

             (1)    Documents, data, reports, or other information required to be collected, developed, maintained, or reported to an agency pursuant to state or federal law or order. However, any disclosure under section 2 of this Act does not in and of itself make this exception applicable; or

             (2)    Information obtained by observation, investigation, or monitoring by any agency.".

         A LEGISLATIVE COMMEMORATION,  Honoring Dr. Thomas R. Hills of Black Hills State University on twenty-five years of outstanding service to the South Dakota Legislative Internship Program.

     WHEREAS,  Dr. Thomas R. Hills, professor of political science at Black Hills State University, began serving as a campus coordinator for the South Dakota Legislative Internship Program during the 1977-78 school year; and

     WHEREAS,  Dr. Hills, since that first year, has assisted in the recruitment of over one hundred Black Hills State University students as legislative interns and has served as a valuable mentor to these students; and

     WHEREAS,  Dr. Hills has been a model campus coordinator and a valuable advisor to, and a promoter of, the South Dakota Legislative Internship Program, year after year; and

     WHEREAS,  this year marks the twenty-fifth consecutive year in which Dr. Hills has served as a campus coordinator for the South Dakota Legislative Internship Program at Black Hills State University:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Seventy-seventh Legislature of the State of South Dakota, that Dr. Thomas R. Hills of Black Hills State University be hereby recognized, congratulated, and thanked for twenty-five years of dedicated and outstanding service to the South Dakota Legislature as a campus coordinator for the South Dakota Legislative Internship Program.
