     On page 1 of the printed bill, delete lines 4 to 9, inclusive, and insert:

"      Section 1. That § 32-15-2.6 be amended by adding thereto a NEW SUBDIVISION to read as follows:

     "Splash guards," mud flaps, fenders, rubber, plastic or fabric aprons, or other devices directly behind the rear-most wheels designed to minimize the spray of water, mud, rocks, and other substances to the rear.

     Section 2. That chapter 32-15 be amended by adding thereto a NEW SECTION to read as follows:

     A person may not move or permit to be moved any motor vehicle with six or more tires, or any vehicle equipped with tires protruding more than six inches beyond the wheel opening upon the public highways without having first equipped the rearmost wheels or set of wheels of the vehicle with splash guards. The splash guards shall be designed, constructed, and attached to the vehicle in a manner that arrests and deflects dirt, mud, water, rocks, and other substances that may be picked up by the rear wheels of the vehicle and thrown into the air. Splash guards shall be:

             (1)    Wide enough to cover the full tread of the tire or tires being protected;

             (2)    Hang perpendicular from the vehicle not more than twelve inches above the surface of the street or highway if the vehicle is empty; and

             (3)    Generally maintain their perpendicular relationship to the surface of the street or highway under normal driving conditions.

     A violation of this section is a Class 2 misdemeanor.

     Section 3. That chapter 32-15 be amended by adding thereto a NEW SECTION to read as follows:

     Section 2 of this Act does not apply to any:

             (1)    Utility pole trailer, lowboy trailer, or drop-deck trailer that by means of its design accomplishes the requirements of section 2 of this Act;

             (2)    Vehicle actively used in chip and seal or paving operations;

             (3)    Truck tractor or converter dolly if used in combination with any other vehicle;

             (4)    Motorcycle or off-road vehicle as defined in §  32-20-1;

             (5)    Farm tractor, combine, or implement of husbandry operated at a speed of twenty-five miles an hour or less;

             (6)    Street rod vehicle, classic car, or other historic motor vehicle not originally equipped or not required by federal law or regulation at the time of manufacture to have splash guards; or

             (7)    Vehicle drawn by animals."
