         A CONCURRENT RESOLUTION,  Commending Aberdeen Central High School's Environmental Club and designating May 15, 2002, as statewide Ride a Bike to Work Day.

     WHEREAS,  the Environmental Club at Aberdeen Central High School is an educational organization of committed South Dakota young people who have an interest in understanding the relationship between the needs of the human population and the capabilities and resources of the natural environment; and

     WHEREAS,  in addition to expanding their knowledge of the natural environment and the earth's ecosystems, the members of the Aberdeen Central Environmental Club strive to achieve an understanding of the practical possibilities by which people can help to improve the condition of our natural environment; and

     WHEREAS,  the Aberdeen Central Environmental Club has proposed, as a small step toward environmental awareness, environmental protection, promotion of a healthy lifestyle, and simple enjoyment of the surroundings in their community, that May 15, 2002, be designated as "Ride a Bike to Work Day":

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- seventh Legislature of the State of South Dakota, the Senate concurring therein, that the Environmental Club at Aberdeen Central High School is to be honored and commended for their efforts and achievements and that May 15, 2002, is hereby designated as "Ride a Bike to Work Day" throughout the State of South Dakota.

         A CONCURRENT RESOLUTION,  Urging the Public Utilities Commission, Qwest Corporation, and the Federal Communications Commission to proceed as quickly as possible with the process of allowing Qwest Corporation to provide interstate telecommunications services in South Dakota.

     WHEREAS,  the Federal Telecommunications Act of 1996 was approved by Congress to promote competition in all segments of the telecommunications market; and

     WHEREAS,  competition in the telecommunications industry is expected to reduce the cost of local and long distance service, increase the advancement of new telecommunications technologies and systems in the state, and to improve services for customers; and

     WHEREAS,  Section 271 of the Federal Telecommunications Act of 1996 specifically sets forth the criteria for determining whether Qwest's local exchange markets are open to competitors; and

     WHEREAS,  Section 271 allows Qwest Corporation to provide interstate telecommunications services to customers in its local service areas once the criteria for opened markets are satisfied; and

     WHEREAS,  Section 271 approval must be granted by the Federal Communications Commission in consultation with the Public Utilities Commission:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- seventh Legislature of the State of South Dakota, the Senate concurring therein, that the Public Utilities Commission move the Section 271 process forward as quickly as possible; and

     BE IT FURTHER RESOLVED,  that the South Dakota Legislature urges the Federal Communications Commission to move the Section 271 process forward as quickly as possible; and

     BE IT FURTHER RESOLVED,  that the Secretary of State forward copies of this resolution to each member of the Public Utilities Commission, the chief executive officer of Qwest Corporation, each member of the Federal Telecommunications Commission, and to each member of the South Dakota Congressional Delegation.

     On page 2, after line 9 of the printed bill, insert:

"      Section 2. That § 13-13-10.1 be amended to read as follows:

     13-13-10.1.   Terms used in this chapter mean:

             (1)      "Average daily membership," the average number of resident and nonresident kindergarten through twelfth grade pupils enrolled in all schools operated by the school district during the previous regular school year, minus average number of pupils for whom the district receives tuition, except pupils described in subdivision (1A) and pupils for whom tuition is being paid pursuant to §   13-28-42 and plus the average number of pupils for whom the district pays tuition;
             (1A)      Nonresident students who are in the care and custody of the Department of Social Services, the Unified Judicial System, the Department of Corrections, or other state agencies and are attending a public school may be included in the average daily membership of the receiving district when enrolled in the receiving district. When counting a student who meets these criteria in its general enrollment average daily membership, the receiving district may begin the enrollment on the first day of attendance. The district of residence prior to the custodial transfer may not include students who meet these criteria in its general enrollment average daily membership after the student ceases to attend school in the resident district;
             (2)      "Adjusted average daily membership," calculated as follows:
             (a)      For districts with an average daily membership of two hundred or less, multiply 1.2 times the average daily membership;
             (b)      For districts with an average daily membership of less than six hundred, but greater than two hundred, raise the average daily membership to the 0.8293 power and multiply the result times 2.98;
             (c)      For districts with an average daily membership of six hundred or more, multiply 1.0 times their average daily membership;
             (3)      "Index factor," is the annual percentage change in the consumer price index for urban wage earners and clerical workers as computed by the Bureau of Labor Statistics of the United States Department of Labor for the year before the year immediately preceding the year of adjustment or three percent, whichever is less;
             (3A)      "Enrollment adjustment," is one-half of the negative of the annual percent change in the statewide general enrollment average daily membership for the year before the year immediately preceding the year of adjustment;
             (4)      "Per student allocation," for the period January 1, 1997, to June 30, 1997, inclusive, is $1,675. For school fiscal year 1998, beginning on July 1, 1997, the per student allocation shall be $3,350 increased by the index factor. Each school fiscal year thereafter, the per student allocation shall be the previous fiscal year's per student allocation increased by the index factor, plus the enrollment adjustment;
             (5)      "Local need," the per student allocation multiplied by the sum of the adjusted average daily membership and 0.05 times the number of alternative education students participating in cocurricular activities in the school district pursuant to section 1 of this Act ;
             (6)      "Local effort," the amount of ad valorem taxes generated in a school fiscal year by applying the levies established pursuant to §   10-12-42;
             (7)      "General fund balance," the unreserved fund balance of the general fund, less general fund exclusions plus, beginning with transfers made in fiscal year 2001, any transfers out of the general fund for the previous school fiscal year;
             (8)      "General fund balance percentage," is a school district's general fund balance divided by the school district's total general fund expenditures for the previous school fiscal year, the quotient expressed as a percent;
             (9)      "General fund base percentage," is the general fund balance percentage as of June 30, 2000. However, the general fund base percentage can never increase and can never be less than twenty percent;
             (10)      "Allowable general fund balance," the fund base percentage multiplied by the district's general fund expenditures in the previous school fiscal year;
             (11)      "Imputed interest rate," the average prime rate for the preceding fiscal year minus 2.5 percentage points;
             (12)      "General fund exclusions," revenue a school district has received from the imposition of the excess tax levy pursuant to §   10-12-43; revenue a school district has received from gifts, contributions, grants, or donations; revenue a school district has received under the provisions of § §   13-6-92 to 13-6-96, inclusive; and any revenue in the general fund set aside for a noninsurable judgment. ".

     HB 1131:   FOR AN ACT ENTITLED, An Act to   provide for civil recovery of unpaid motor fuel.

     Having had its second reading was up for consideration and final passage.

     Rep. Duane Sutton moved that HB 1131 be amended as follows:

     On page 2, after line 18 of the printed bill, insert:

"      Section 6.That chapter 22-30A be amended by adding thereto a NEW SECTION to read as follows:

     Any person who obtains property or services from a hotel or restaurant without paying for it is liable to the retailer for the cost of the property or service. In addition, the retailer may impose a maximum service charge of thirty dollars for collection costs if the service charge was conspicuously displayed on the premises.

     Section 7. That chapter 22-30A be amended by adding thereto a NEW SECTION to read as follows:

     If the retailer records the motor vehicle license plate number of the person who obtained property or services without paying, the retailer may contact any law enforcement officer and provide the license plate number in writing and the law enforcement officer shall provide the motor vehicle owner's address, recorded pursuant to §  32-5-3, in order for the retailer to mail a notice and demand of payment for property or services.

     Section 8. That chapter 22-30A be amended by adding thereto a NEW SECTION to read as follows:

     The notice and demand of payment for property or services shall include the name, address, and license plate number of the motor vehicle owner; the date the act occurred; the unpaid dollar amount; the service charge; a citation of sections 6 and 9 of this Act; and the employee's signature. An affidavit of service by mailing shall be retained by the retailer.

     Section 9. That chapter 22-30A be amended by adding thereto a NEW SECTION to read as follows:

     If the retailer does not receive payment within thirty-three days after mailing the notice and demand for payment for property or services, the vehicle owner is also liable for a civil penalty of one hundred dollars, or the price of the unpaid property or services, whichever is greater.

     Section 10. That chapter 22-30A be amended by adding thereto a NEW SECTION to read as follows:

     Any person may dispute the retailer's claim by sending written notice to the retailer during the thirty-three day period in section 9 of this Act. The retailer shall cease all collection efforts upon receipt of the notice. The retailer may collect the price of the property or service, the service charge, and the civil penalty only pursuant to a judgment from a court of law.".
