To the Speaker of the House of Representatives:

    Representatives Mel Olson and Quinten Burg, pursuant to Joint Rule 1-10, wish respectfully to dissent and protest the passage of Senate Bill 27 and the ruling of the chair that the bill required a simple majority for passage. This bill is one which sets aside state revenue in a special fund. This revenue is no longer available for the ordinary expenses of state government since it has already been set apart; consequently, it is a form of "other appropriations" covered by Section 2 of Article XII. These revenues are no longer available for the Legislature to appropriate for the "ordinary expenses" of state government. Any bill which segregates funds which would otherwise go into the general fund falls under the definition of "other appropriations" and thus the two-thirds vote requirement.

    We therefore feel the passage of this Act by a simple majority is in contravention of the Constitution and as such is null and void.

    We respectfully request this dissent be printed in the House Journal.

     SB 226:   FOR AN ACT ENTITLED, An Act to   revise and supplement certain powers of the South Dakota Building Authority, to provide for the establishment of a corporation by the South Dakota Building Authority for the purpose of raising funds for specified purposes, to provide for transfer and sale at any one time or from time to time of a portion of or all future right, title, and interest of the State of South Dakota to certain amounts payable to the state by various tobacco companies under a master settlement agreement in exchange for the deposit of the net proceeds of such sale into the state permanent tobacco settlement development trust fund, to establish certain funds, and to declare an emergency.

     On page 13 of the House State Affairs Committee engrossed bill, delete lines 6 to 16 , inclusive, and insert:

"      Section 13. It is the intention of this Legislature that funds deposited in the tobacco development interest fund and the tobacco settlement residual fund be expended for:

             (1)    Grants for college scholarships designed to encourage and reward postsecondary academic excellence;

             (2)    Grants designed to encourage and reward academic excellence in primary and secondary education;

             (3)    Grants designed to reduce the use of tobacco products by our state's citizens; and

             (4)    Grants enacted pursuant to separately enacted statutes which will implement development programs intended to provide for the health, welfare, and prosperity of the State of South Dakota and its residents.

     Any grant or development program, not expressly provided for in this section, shall be established by a separately enacted statute which makes express reference to this Act; and the terms and conditions of such program, which shall be designed to provide for the health, welfare, and prosperity of the State of South Dakota and its residents, shall be specified in such statute. Any such statute shall expressly incorporate any agreements, covenants, or restrictions described or referred to in or by sections 6 and 12 of this Act and any investment, use, expenditure, or other application of moneys described in section 12 of this Act shall be expressly subject to and in full compliance with the agreements, covenants, restrictions, and conditions imposed by the terms of section 12 of this Act.".

     Section  1.  The Legislature finds that financial aid to qualified resident students in education beyond high school in South Dakota is in the public interest.

     Section  2.  Terms used in this Act mean:

             (1)    "Eligible institution," any postsecondary education institution, located in South Dakota, including all public and private nonprofit and proprietary institutions, four- year colleges and universities, community and junior colleges, area technical or vocational schools, trade schools, technical institutes, schools of nursing or of the health professions, or any institution which is determined by the secretary to be regularly accredited to offer postsecondary educational services by a recognized and appropriate accrediting agency, as determined by the secretary, and which has an agreement with the United States secretary of education for the conduct of any of the programs established under Title IV of The Higher Education Act of 1965 as amended through January 1, 2001;

             (2)    "Qualified student," any resident student designated as a regents scholar by the Department of Education and Cultural Affairs, who is enrolled in an eligible institution within one year of high school graduation, maintaining satisfactory progress and who is a full-time student as certified by the institution;

             (3)    "Regents scholars program scholarship," any award by the department to a qualified student under this Act;

             (4)    "Regents scholar," a South Dakota high school graduate completing the following high school courses with no final grade below a "C" and an average grade of "B" (3.0 on a 4.0 scale):

             Four units of English
             Four units of Math*
             Four units of Science*
             Three units of Social Studies
             Two units of modern or classical Language**
             One-half unit of Fine Arts
             One-half unit of Computer Science
             * Three units of algebra or higher math and three units of an approved lab science
             ** American Sign Language is considered a modern language

             (5)    "Resident student," any person who has been determined by the secretary to be a resident of South Dakota and who is enrolled at an eligible institution;

             (6)    "Secretary," the secretary of the Department of Education and Cultural Affairs.

     Section  3.  There is hereby established the regents scholars program to be administered by the Department of Education and Cultural Affairs.

     Section  4.  The purpose of this program is to reward graduating South Dakota high school seniors, designated as regents scholars, with a one-time, one thousand dollar ($1,000) scholarship, thereby encouraging them to continue their postsecondary education in South Dakota at any eligible institution.

     Section  5.  There is hereby appropriated from the people's interest fund the sum of one million two hundred thousand dollars ($1,200,000), or so much thereof as may be necessary, to the Department of Education and Cultural Affairs to provide scholarships pursuant to this Act.

     Section  6.  The secretary of the Department of Education and Cultural Affairs shall approve vouchers and the state auditor shall draw warrants to pay expenditures authorized by this Act.

     Section  7.  Any amounts appropriated in this Act not lawfully expended or obligated by June   30, 2002, shall revert in accordance with §   4-8-21.

     Section  8.  The secretary may award a regents scholar scholarship in the amount of one thousand dollars ($1,000), to any qualified, designated regents scholar as defined in this Act.

     Section 9. If it is determined that a student cannot complete the course requirements as provided in section 2, subdivision (4) of this Act, due to the unavailability of the courses of study at the student's high school, the student may be admitted into the regents scholars program.

     Section 10. Each applicant, in accordance with the rules promulgated by the secretary, shall:

             (1)    Complete and file an application for a regents scholar program scholarship; and
             (2)    Report promptly to the secretary any information requested which is necessary to make proper determination with respect to the student's application.

     Section 11. The secretary shall promulgate rules, pursuant to chapter 1-26, to administer the regents scholar program. The rules shall include:

             (1)    Specification of application forms;
             (2)    Criteria for approval or disapproval of scholarships;
             (3)    Procedures for proration of funds if scholarship applications exceed available funds; and
             (4)    Specific records to be kept according to accounting practices.".

The entitlement provided for in this section is contingent upon the student successfully meeting the terms of the scholarship and successfully completing a full academic year.

     Section 2. A school district shall annually apply to the Board of Regents for its entitlement as provided for in section 1 of this Act.

     Section 3. Notwithstanding §  10-50B-11, there is hereby continuously appropriated out of any money in the people's trust fund any money necessary to provide the entitlement provided for in this Act to the Board of Regents.

     Section 4. The Board of Regents may promulgate rules pursuant to chapter 1-26 to accept applications and establish eligibility criteria."

COMMEMORATIONS


     HC 1019   Introduced by:  Representatives Gillespie and Broderick and Senator Albers

         A LEGISLATIVE COMMEMORATION,  Honoring Virgil Fodness of Lennox for receiving the Frederick G. Simonton Award for his service to rural life.

     WHEREAS,  few South Dakotans have served their rural community with more diligence and dedication than Virgil Fodness who began farming in 1940, representing rural interest locally, regionally, and nationally; and

     WHEREAS,  Virgil was a member of the Lincoln County Planning Board for twenty-nine years and chairman of the board for ten years, a member of the Lincoln County Economic Development Association Board, president of the Lincoln-Union Electric Cooperative Board for fourteen years, elected as president of the East River Board of Directors for sixteen years, president of the Mid-West Board, and a member and vice president of the Board of the Consumer Federation of America in Washington, D.C.; and

     WHEREAS,  Virgil has been married to his wife, Ardis, for fifty-five years with whom he raised three children, and now has nine grandchildren and one great-granddaughter, all of whom have provided Virgil with support and encouragement throughout his life:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Seventy-sixth Legislature of the State of South Dakota, that Virgil Fodness be recognized as a recipient of the Frederick G. Simonton Award for his service to rural life.
