         A CONCURRENT RESOLUTION,  Urging revision of the Federal Freedom to Farm Act.

     WHEREAS,  federal Freedom to Farm legislation which passed in 1996, has failed miserably to provide a safety net for farm income; and

     WHEREAS,  resulting overproduction of South Dakota commodities has led to prices far below the cost of production for South Dakota's family farmers; and

     WHEREAS,  increased export volume since 1996 has not led to higher prices for South Dakota farm products; and

     WHEREAS,  emergency bailout packages in 1998, 1999, and 2000 have not and will not fix a failed farm policy:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- sixth Legislature of the State of South Dakota, the Senate concurring therein, that the South Dakota Legislature urges the United States Congress to immediately change the Freedom to Farm law by raising commodity loan rates, reinstituting a farmer-controlled reserve, and providing discretion for conservation-driven land idling incentives in times of oversupply, while retaining planting flexibility provisions in the commodity programs; and

     BE IT FURTHER RESOLVED,  that United States farm policy benefits should be directed to family-sized farms, and loopholes allowing enormous payments to mega-farms should be eliminated.

         A CONCURRENT RESOLUTION,  Endorsing and encouraging the Central North American Trade Corridor Association.

     WHEREAS,  the Central North American Trade Corridor Association has been created as a catalyst in the promotion, development, and establishment of a north/south trade corridor along U.S. 83 and its connecting arteries from Canada to Mexico; and

     WHEREAS,  the Central North American Trade Corridor Association will strive to facilitate trade by means of traditional methods, the use of modern technology, and the expanded use of all forms of transportation; and

     WHEREAS,  the Central North American Trade Corridor has the potential to aid in the development of the world's largest trading block:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- sixth Legislature of the State of South Dakota, the Senate concurring therein, that the purposes and establishment of the Central North American Trade Corridor Association be endorsed and encouraged for its potential for stimulating the economy.

         A CONCURRENT RESOLUTION,  In support of the use of biodiesel fuel.

     WHEREAS,  the federal government, under rules proposed by the Environmental Protection Agency, is proposing to reduce sulfur levels in all on-road diesel fuel sold in the United States from current levels of approximately five hundred parts per million by 2007; and

     WHEREAS,  once this rule is fully adopted, this reduction in sulfur content to improve air quality will also reduce or nearly eliminate this new fuel's ability to provide adequate lubrication for vital engine parts; and

     WHEREAS,  South Dakota consumes nearly 230 million gallons of diesel fuel per year produced from sources outside the state:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- sixth Legislature of the State of South Dakota, the Senate concurring therein, that the South Dakota Legislature supports the use of biodiesel as the lubricating agent of choice, be it at two percent to five percent for all diesel fuel offered for sale in the State of South Dakota; and

     BE IT FURTHER RESOLVED,  that the Legislature supports the use of biodiesel for all diesel fuel offered for sale in South Dakota as a means to reduce South Dakota's dependence on imported oil, improve South Dakota's air quality, and to build a strong and stable domestic market for South Dakota produced soybean oil.

         A CONCURRENT RESOLUTION,  Requesting that the Governor of the State of South Dakota, along with the Legislature, continue to take appropriate fire prevention measures to address the catastrophic fire risk that exists on the federally-held national forests and state lands of South Dakota.

     WHEREAS,  the Governor of the State of South Dakota , along with the South Dakota State Legislature, has taken the steps of creating the position of Wildfire Coordinator through House Bill 1146, appropriating two million dollars for wildfire suppression through Senate Bill 221, and is currently working with the United States Forest Service to secure further funding and assistance to help thin underbrush within the state's national forests; and

     WHEREAS,  the Otero County, New Mexico, Board of County Commissioners has enacted an Emergency Declaration Resolution to address the risk of catastrophic fire on federal and New Mexico lands; and

     WHEREAS,  fire risk conditions resulting from the infrequent clearing of underbrush within the federally-held national forests and other state-held lands, along with other pest and noxious weed problems do exist in South Dakota; and

     WHEREAS,  the Meade County Board of County Commissioners has recognized the Otero County resolution to be an appropriate and effective remedy for the situation facing not only the people of New Mexico but also the people of South Dakota; and

     WHEREAS,  the Governor of the State of South Dakota along with the Legislature of the State of South Dakota has the same duty to protect the lives and property of their citizens as the county commissioners of Otero and Meade counties do:

     NOW, THEREFORE, BE IT RESOLVED,  by the House of Representatives of the Seventy- sixth Legislature of the State of South Dakota, the Senate concurring therein, that the Governor of the State of South Dakota, along with the Legislature, is urged to continue to take the appropriate fire prevention and maintenance measures necessary to remove and control this threat to the citizens of this state.
