MOTIONS AND RESOLUTIONS

     HCR 1017: A CONCURRENT RESOLUTION, Urging a finding by the United States Fish and Wildlife Service that the black-tailed prairie dog is not likely to become an endangered species.

     Was read the first time, the President waived the referral to committee, and placed HCR 1017 on the calendar of Tuesday, March 10, the 36th legislative day.

     SCR 10  Introduced by:  Senators Kloucek, Ahlers, Bartling, Bradford, Fryslie, Garnos, Gillespie, Gray, Hanson (Gary), Howie, Maher, Merchant, Miles, Nesselhuf, Olson (Russell), Peterson, Schmidt, Tieszen, and Turbak Berry and Representatives Lederman, Brunner, Cronin, Deadrick, Elliott, Feickert, Frerichs, Hamiel, Jensen, Juhnke, Kirkeby, Kopp, Lange, Moser, Nygaard, Olson (Betty), Putnam, Sly, Solberg, Steele, Street, Thompson, Verchio, and Wink

         A CONCURRENT RESOLUTION,  Supporting legislative efforts in other states addressing the need to provide for equine slaughter and processing in the United States.

     WHEREAS,  there are currently no horse processing facilities in operation in the United States, and federal legislation was introduced to prohibit the transport or sale of horses and other equines for slaughter or processing; and

     WHEREAS,  the equine industry faces an unprecedented crisis as thousands of unwanted horses are exposed to abandonment and neglect because of the cessation of horse slaughter in the United States, and efforts to prohibit the transport and export of horses for slaughter only exacerbate this problem; and

     WHEREAS,  there is a critical need for humane horse processing facilities in the United States. The nation's overburdened horse rescue and adoption facilities cannot begin to handle the influx of additional abandoned horses each year that results from the cessation of equine slaughter, processing, and transport activity; and

     WHEREAS,  in the United States, the harvest of animals under federal inspection is highly
regulated to provide for humane handling of the animals and for a safe and wholesome product. Horse processing in the United States was the most tightly regulated of any animal harvest. Horse processing facilities cannot be established in the United States unless federal inspection for such facilities is reinstated; and

     WHEREAS,  the North Dakota Legislature is currently considering HB 1496 to authorize and fund a feasibility study for an equine processing facility to meet the needs of the equine industry in the current crisis; and

     WHEREAS,  the Illinois Legislature is considering HB 0583 to reinstate certain inspection and regulation activity related to horse slaughter and processing facilities as well as other provisions to facilitate the resumption of such activity in Illinois; and

     WHEREAS,  the Montana Legislature is considering HB 418, a measure to encourage private horse slaughter plant development. The bill would prohibit state courts from granting injunctions designed to stop or delay construction of horse slaughter or processing facilities based on permit or licensing challenges or on environmental grounds; and

     WHEREAS,  the Midwestern Legislative Conference of the Council of State Governments at its 2007 and 2008 meetings passed resolutions in support of horse processing and related activities in the United States:

     NOW, THEREFORE, BE IT RESOLVED,  by the Senate of the Eighty-fourth Legislature of the State of South Dakota, the House of Representatives concurring therein, that the South Dakota Legislature supports actions proposed by the state legislatures in North Dakota, Montana, Illinois, and other states to facilitate the resumption of equine processing and slaughter in the United States and urges the Congress and the United States Department of Agriculture to reinstate USDA's inspection program for horse slaughter facilities and to lift restrictions on horse slaughter and processing activities and facilities in the United States.

    "Section 2. That chapter 22-24 be amended by adding thereto a NEW SECTION to read as follows:

     It is not a defense to the crimes of public indecency as defined in §  22-24-1.1 or indecent exposure as defined in §  22-24-1.2 that the place where the act of exposure occurs is a private place rather than a public place if:

             (1)    The perpetrator and the victim have no interpersonal relationship;

             (2)    The perpetrator has no right to be in the private place where the act of exposure occurs other than the permission, invitation, acquiescence, or sufferance of the property owner or the property owner's agent;

             (3)    The perpetrator and the property owner or property owner's agent have no interpersonal relationship; and

             (4)    The perpetrator and the victim are not related, by blood, marriage, or adoption, within the fourth degree of kinship.

     For the purposes of this section, the term, interpersonal relationship, does not extend to any casual relationship arising primarily out of any business, professional, commercial, service, or similar social interaction."

COMMEMORATIONS

     SC 24  Introduced by:  Senator Vehle and Representatives Carson and Hamiel

         A LEGISLATIVE COMMEMORATION,  Celebrating the life of Gerhard Storm of Mitchell, South Dakota, on the occasion of his 90th birthday.

     WHEREAS,  Gerhard Storm was born on March 26, 1919, in Douglas County, South Dakota, to Gustav and Caroline Storm and holds much pride in being a life-long resident of South Dakota; and

     WHEREAS,  Gerhard Storm was a member of the 135th Infantry Regiment, a unit of the 34th "Red Bull" Division with Lieutenant General Mark W. Clark's Fifth Army during World War II. Gerhard served in the Army from January 1941 through June 1945 serving as a medic as they battled through North Africa and Italy; and

     WHEREAS,  Gerhard Storm returned home to marry his sweetheart, Lorraine, and they celebrated their sixty-third wedding anniversary on September 12, 2008. Gerhard and Lorraine have six children, sixteen grandchildren, and twelve great-grandchildren, and when the family gathers for special occasions and celebrations there are over fifty (and counting) in attendance; and

     WHEREAS,  Gerhard Storm was a proud and progressive farmer for over thirty years and remains active in his church and community. Over the years Gerhard has driven over a million miles in several countries and states and enjoys activities such as dancing, playing cards, golfing, and bowling. Gerhard is often at the head of his bowling league, and recently, at age 89, bowled a 236:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-fourth Legislature of the State of South Dakota, that Gerhard Storm be congratulated on his 90th birthday and commended for the service and support he has given to his country, his community, his church, and his family.

         A LEGISLATIVE COMMEMORATION,  expressing the Legislature's respect and appreciation for the sixteen years of devoted service by Gil Koetzle, the first and only legislator in the history of South Dakota to be term limited out of the House of Representatives and the Senate.

     WHEREAS,  Gil Koetzle faithfully served his state and the people of his district as a member of the South Dakota House of Representatives for eight years, holding the position of Minority Whip from 1993 - 2000. In addition, he served in the South Dakota Senate for eight years, reaching his term limit in 2008; and

     WHEREAS,  Gil Koetzle was a member of the Legislative Research Council Executive Board from 2003 - 2008 and served on the State Tribal Relations Committee from 2003 - 2004; and

     WHEREAS,  Gil Koetzle was known as "the preacher" because of his outstanding speaking ability, as well as "the voice of labor" to his fellow legislators; and

     WHEREAS,  Gil Koetzle is a dedicated husband, father, and grandfather. He and his wife Deb have two children, Jesse and Stephanie, and three grandchildren, Bode, Elizabeth, and Tanner:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-fourth Legislature of the State of South Dakota, that the South Dakota Legislature extends its undying respect and gratitude to Gil Koetzle for his commitment to public service in the State of South Dakota as the first and only legislator in the history of the state to be term limited out of both the House of Representatives and the Senate.
