"      Section  1.  Terms used in this Act mean:

             (1)    "Commission," the South Dakota Game, Fish and Parks Commission, acting directly or through its duly authorized officers or agents;

             (2)    "Fishing preserve," a body of water as provided in this Act and adjoining land and facilities either privately owned or leased in which the body of water has been stocked with fish for the purpose of fishing, for a fee, over an extended season;

             (3)    "Person," individuals, copartnerships, associations, and corporations.

     Section  2.  The Game, Fish and Parks Commission may issue and renew fishing preserve operating permits for privately-owned and operated fishing preserves as provided in this Act.

     Section  3.  Any person owning, holding, or controlling, by lease or otherwise, any contiguous tract of land that is adjacent to a body of water may apply for the establishment of a fishing preserve as provided in this Act if the applicant agrees to stock the body of water with fish as provided in rules promulgated by the commission pursuant to chapter 1-26 and if one of the following criteria is met:

             (1)    The tract of land completely surrounds a body of water and the body of water cannot be legally accessed by the public without permission of the owner, tenant, or lessee; or

             (2)    The tract of land is adjacent to a body of water that is accessible to the public by means of a public right-of-way and the commission determines that it would be in the public interest to close public access to the body of water for purposes of establishing a fishing preserve pursuant to this Act.

     Section  4.  Any person who desires to establish a fishing preserve under the provisions of this Act shall apply to the Game, Fish and Parks Commission for a fishing preserve operating permit. The application may be made by the applicant or the applicant's agent or attorney, and shall be accompanied by an application fee determined by the commission in rules promulgated pursuant to chapter 1-26.

     Section  5.  Upon receipt of a written application for a new fishing preserve operating permit, the commission shall schedule a public hearing on the application. The department shall publish notice of the time, place, and purpose of the hearing once at least twenty days before the hearing in at least

three newspapers of general circulation in areas of the state likely to be affected by the proposed permit. After the hearing, the commission may issue the permit in accordance with the requirements of this Act.

     Section  6.  Upon receipt of the application for a fishing preserve operating permit commission shall inspect the area described in the application, the premises, and the facilities. The commission also shall evaluate the ability of the applicant to operate an area of this character and, if applicable, whether it would be in the public interest to close public access to the body of water for purposes of establishing the fishing preserve.

     Section  7.  In determining whether to approve an application for a fishing preserve, the Game, Fish and Parks Commission shall consider the following:

             (1)    The applicant for a fishing preserve operating permit proposes to comply with all of the provisions of this Act;

             (2)    The applicant is financially able to provide the necessary facilities and services to operate a fishing preserve;

             (3)    The preserve shall be open to the general public without restrictions as to race, color, gender, religion, or national origin;

             (4)    The operation will not work a fraud upon persons who are permitted to fish thereon;

             (5)    The operation is not designed to circumvent game, fish, and wildlife laws and rules;

             (6)    The issuance of the permit will be in the public interest;

             (7)    The applicant is a resident of the state; and

             (8)    The applicant does not operate or own any interest in more than two fishing preserves.

     If the commission finds that the preserve would not take unfair advantage of fish habitat and fish population existing on the proposed fishing preserve, or would not otherwise be detrimental to the public interest; the commission shall approve the application and issue a fishing preserve operating permit for the operation of a fishing preserve on the property described in the application with the rights and subject to the limitations prescribed in this Act and in rules promulgated by the commission pursuant to this title. If applicable, and if the commission has determined that closing public access to the body of water associated with the fishing preserve is in the public interest, the commission shall order the closure of public access to the body of water.

     Section  8.  Any fishing preserve operating permit shall be issued upon the condition that the

permittee agrees that any law enforcement officer or any representative of the Department of Game, Fish and Parks may enter and search the premises and any part thereof without a search warrant to ensure compliance with the laws of this state and rules of the commission. Failure to comply with this section is a Class 1 misdemeanor.

     Section  9.  The Game, Fish and Parks Commission shall promulgate rules pursuant to chapter 1- 26 to specify:

             (1)    Types, species, quantities, and limits of fish that may be taken at a fishing preserve, which may not exceed quantities and limits established for the same species and types of fish on waters not included within a fishing preserve;

    (2)    The season length, which may not exceed the corresponding season length on waters not included within a fishing preserve;

             (3)    License requirements and license fees for persons who fish at a fishing preserve, except that the license requirements and fees may not be more stringent or higher than corresponding license and fee requirements on waters not included in a fishing preserve;

             (4)    Requirements relating to the handling and transporting of fish taken at the fishing preserve;

    (5)    Requirements related to the stocking of fish on a fishing preserve in accordance with the provisions of this Act;

             (6)    Record-keeping requirements related to the operations of the fishing preserve;

             (7)    Requirements for marking or posting the body of water in the fishing preserve;

             (8)    Criteria and procedures for determining whether a body of water is to be closed to public access and made eligible for fishing preserve status;

             (9)    Fees to be charged the operator for applying for a fishing preserve operating permit and annual operating fees to be charged to a fishing preserve operating permit holder;

             (10)    Requirements related to the administration and inspection of the fishing preserve.

     Section  10.  The patron of a fishing preserve operator, after securing any necessary fishing licenses as required by this Act, may harvest any fish in the fishing preserve.

     Section  11.  Within the limits established in rules by the commission, the fishing preserve operator may establish additional limitations and restrictions on the number, size, type, and species

of fish that may be taken by each person, and the operator may establish fishing hours and the fees to be charged to patrons.

     Section  12.  Any person licensed to fish as required by this Act may harvest and legally possess fish taken at a fishing preserve if the fish are taken, handled, and transported as directed by the commission in rule.

     Section  13.  In addition to other record-keeping requirements established by the commission in rule, each fishing preserve operator shall maintain a guest register in which is listed the name, address, and applicable fishing license number of each patron, the date on which the patron fished, and the species and amount of fish taken. Likewise, a record shall be maintained to show the source of the fish stocked or released and of the date and the number of each fish species stocked or released. These records are be open to inspection by the Department of Game, Fish and Parks at any reasonable time. A violation of this section is a Class 1 misdemeanor.

     Section  14.  It is a Class 1 misdemeanor to own, operate, lease, or control a fishing preserve without the operating permit authorized by this Act or in violation of statute, the conditions of the permit or the rules of the commission.

     Section  15.  The commission may pursuant to chapter 1-26 revoke or suspend the permit of a permittee for any violation of this Act or any of the rules of the commission. An appeal may be taken to the circuit court pursuant to the procedure of chapter 1-26 within ten days after a decision of the commission to suspend or revoke a shooting preserve operating permit. The circuit court may take additional evidence in any action which is appealed from the administrative determination."
