     On the printed bill, delete everything after the enacting clause and insert:

"      Section  1.  Any person eighteen years of age or older arrested or prosecuted for the misdemeanor possession or use of marijuana, pursuant to §  22-42-6, has an affirmative defense of medical necessity if the following is met:

             (1)    The person has a medical condition for which marijuana is a palliative; and

             (2)    Prior to the arrest, or conduct leading to the arrest, the person has a recommendation for the medicinal use of marijuana dated and signed by a physician licensed pursuant to chapter 36-4; and

             (3)    That the recommendation identifies the medical condition for which the recommendation has been made; and

             (4)    That the recommendation contains an expiration date after which the medicinal use of marijuana recommendation is terminated; and

             (5)    That notice of the affirmative defense of medical necessity is provided pursuant to section 4 of this Act.

     Section  2.  The affirmative defense of medical necessity provided for in section 1 of this Act is unavailable for:

             (1)    Any crimes other than misdemeanor possession or use of marijuana pursuant to §  22-42- 6; or

             (2)    Possession or use of marijuana prior to the signature date of the recommendation defined in section 1 of this Act or after the expiration date contained in the recommendation.

     Section  3.  The defendant has the burden of proof establishing each of the elements of the affirmative defense described in section 1 of this Act.

     Section  4.  That § 23A-8-3 be amended to read as follows:


     23A-8-3.   Any defense, objection, or request which is capable of determination without the trial of the general issue may be raised before trial by motion. Motions may be written or oral at the discretion of the judge. The following must be raised prior to trial:

             (1)      Defenses and objections based on defects in the institution of the prosecution;

             (2)      Defenses and objections based upon prior conviction or acquittal;

             (3)      Defenses and objections based on defects in the indictment or information (other than that it fails to show jurisdiction in the court or to charge an offense which objections shall be noticed by the court at any time during the pendency of the proceedings);

             (4)      Motions to suppress evidence;

             (5)      Requests for discovery under chapter 23A-13; or

             (6)      Requests for a severance of charges or defendants under §  23A-11-2 ; or

             (7)    The defense of medical necessity in prosecutions for misdemeanor possession or use of marijuana . ".
