     The prayer was offered by the Chaplain, Dodie Noordermeer, followed by the Pledge of Allegiance led by House page Angie Settje.

     The Conference Committee respectfully reports that it has considered HB 1096 and the amendment thereto made by the Senate, and the disagreement of the two Houses thereon, and recommends that HB 1096 be amended as follows:
    
     On the Senate Agriculture and Natural Resources committee engrossed bill, delete everything after the enacting clause and insert:

"      Section  1.  If an infestation of noxious weeds or an infestation of mountain pine beetle spreads to adjacent private or public land, the person or entity owning the property from which the infestation spread is responsible for remedying the problems caused by the infestation, to the extent that the person or entity is responsible for allowing the infestation to spread to the adjacent private or public land. "


     On page 1 , line 1 of the Senate Agriculture and Natural Resources committee engrossed bill , delete everything after " to " and insert " assign responsibility related to certain infestations of noxious weeds or the mountain pine beetle. " .

A motorcycle operator's license may be issued to a minor at least sixteen years of age but less than eighteen years of age who does not currently hold a valid operator's license if the minor has passed all motorcycle driver's license examination tests, has not been convicted of a traffic violation during the past six months, and currently holds a motorcycle instruction permit that has been valid continuously for one hundred eighty days. For any minor who has successfully completed the motorcycle safety education courses provided by §  32-20-14 and a driver education class that has been approved by the Department of Education and Cultural Affairs or by the secretary of commerce and regulation, the required minimum time period for holding the motorcycle instruction permit to qualify for the motorcycle operator's license is thirty continuous days. " .

"      Section 10. That § 28-6-1 be amended to read as follows:

     28-6-1.   The Department of Social Services may provide medical services and medical or remedial care on behalf of persons having insufficient income and resources to meet the necessary cost thereof, if the person has exhausted all other possible public and private medical and remedial care programs, income or benefits, with the exception of county poor relief, in accordance with rules which the secretary of social services shall adopt pursuant to chapter 1-26 in accordance with the provisions of Title XIX and Title XXI of the federal Social Security Act, as amended to January 1, 2000 . The rules shall specify the individuals and services for which state funds or federal financial participation are available and may include:

             (1)      The amount, scope, and duration of medical and remedial services;

             (2)      The basis for and extent of provider payments on behalf of an eligible person;

             (3)      The establishment and collection of copayments, premiums, fees, or charges for sharing the cost of risk protection or services provided to persons. All such collections shall be remitted to the general fund;

             (4)      Methods of administration found necessary for the operation of the medical assistance program;

             (5)      Safeguards against the disclosure or improper use of information, required by statutory law to be held confidential, concerning applicants for or recipients of medical assistance; and

             (6)      Such other requirements as may be necessary to obtain federal financial participation in the medical assistance program. "

     13-16-6.4.   Approval to enter into an agreement or issue capital outlay certificates to which §   13-16-6.3 applies is subject to a referendum if five percent of the registered voters, based upon the total number of registered voters at the last preceding general election, petition, within twenty thirty days thereafter, to have the question of approval or disapproval of the agreement or issue of capital outlay certificates or the lease-purchase agreement placed upon the ballot at the next regular election or at a special election called for that purpose. The business manager shall give notice of the fact that the question will be on the ballot at a regular or special election as provided by law for school elections and prepare official ballots therefor according to the provisions of this Title relating to elections and the issue shall be decided by a majority sixty percent of those voting thereon.      The Conference Committee respectfully reports that it has considered HB 1200 and the amendment thereto made by the Senate, and the disagreement of the two Houses thereon, and recommends that HB 1200 be amended as follows:

     On page 2 , delete lines 8 to 11 of the Senate engrossed bill , inclusive , and insert:

"     A school district may refuse to employ a person, either directly or by contract, who has been convicted of a crime involving moral turpitude as defined in subdivision 22-1-2(25).

     No person may be employed by a school district, either directly or by contract, if the person has been convicted of a crime of violence as defined in subdivision 22-1-2(9), a sex offense as defined in §  22-22-30, or trafficking in narcotics.

     Nothing in this section prohibits a school district from considering any criminal conviction in making a hiring decision. "

     On page 2 , line 15 , delete " a " and insert " the same " .

     The Conference Committee respectfully reports that it has considered SB 197 and the amendment thereto made by the House, and the disagreement of the two Houses thereon, and recommends that the House amendments be deleted thus restoring the bill to the Senate State Affairs engrossed version.

     SB 28:   FOR AN ACT ENTITLED, An Act to   provide payment of tuition costs to nonpublic education programs for students in governmental custody and to eliminate certain payments to educational programs operated by public school districts.

     Rep. Cutler moved that SB 28 be amended as follows:

     On the Senate Education committee engrossed bill, delete everything after the enacting clause and insert:

"      Section 1. That § 13-32-4.3 be amended to read as follows:

     13-32-4.3.   If any student is under suspension or expulsion in a school district, the student may not be transferred to another enroll in any school district until the suspension or expulsion has expired. The sending district shall notify, in writing, the receiving district of the suspension or expulsion upon request of the student's permanent school records by the receiving school. The superintendent or school administrator of any school district may prohibit a student from enrolling in that school district if the student is under suspension or expulsion in a school in another state or in a nonpublic school in this state. Upon receiving a request for a student's permanent school records from the receiving district, the sending school shall provide the receiving district with written notice of any suspension or expulsion. "
