     Section 3. That § 10-43-36 be amended to read as follows:

     10-43-36.   Any related corporation required to report under this chapter and owned or controlled either directly or indirectly by another corporation may elect, or may be required by the secretary of revenue, to make a consolidated report with related corporations that are required to report under this chapter showing the combined net income, such assets of the corporation as are required for the purpose of this chapter, and such other information as the secretary of revenue may require by rule promulgated pursuant to chapter 1-26. "

"      Section 1. That § 32-38-1 be amended to read as follows:

     32-38-1.   Except as provided in chapter 32-37 and §   32-38-3, every operator and front seat passenger any adult who is in the front seat and any person under the age of eighteen who is in the front or any back seat of a passenger vehicle operated on a public highway in this state shall wear a properly adjusted and fastened safety seat belt system, required to be installed in the passenger vehicle when manufactured pursuant to Federal Motor Vehicle Safety Standard Number 208 (49 C.F.R. 571.208) in effect January 1, 1989, at all times when the vehicle is in

forward motion. The driver of the passenger vehicle shall secure or cause to be secured a properly adjusted and fastened safety seat belt system on any passenger in the front seat vehicle who is at least five years of age but younger than eighteen years of age. Any violation of this section is a petty offense. Any violation of this section is not a moving traffic offense under the provisions of §   32-12-49.1.

     Section 2. That § 32-38-5 be repealed.

     32-38-5.   Enforcement of this chapter by state or local law enforcement agencies shall be accomplished as a secondary action. A violation of this chapter is a petty offense. "

     HB 1040:   FOR AN ACT ENTITLED, An Act to   continue the moratorium on new nursing facility beds.

     Sen. Valandra moved that HB 1040 be amended as follows:

     On page 2 , after line 6 of the printed bill , insert:

"     Section 4. Notwithstanding the provisions of sections 1 and 2 of this Act, a new nursing facility as defined in §  34-12-1.1 may be constructed, operated, and maintained in an area if the facility is to be located on an Indian reservation and is required to serve a local population previously unserved through lack of vacancies in facilities within a forty-five-mile radius. No more than one such nursing facility may be located within the same Indian reservation, and the number of beds in the nursing facility may not exceed thirty. "


     Sen. Albers moved that Sen. Valandra's motion to amend HB 1040 be laid on the table.

    Sen. Flowers requested a roll call vote.

A LEGISLATIVE COMMEMORATION,  Honoring the memory of former State     Representative Wayne Hauschild.

     WHEREAS,  Wayne A. Hauschild was a devoted public servant who, in addition to being a member of the South Dakota House of Representatives from 1971-80, served in the United States Navy aboard ship during World War II, and was mayor of Brookings, South Dakota, from 1993-99; and

     WHEREAS,  Wayne influenced the lives of many young people as a teacher of United States history and government, and as a coach of football, basketball, golf, tennis, and the Brookings Cubs and Brookings Legion baseball teams; and

     WHEREAS,  Wayne's passing on February 2, 2000, at the age of 74, is universally mourned by his family, teachers, students, athletes, members of his church and community, legislators, and his wide range of friends and acquaintances:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Seventy-fifth Legislature of the State of South Dakota, that Wayne Hauschild's memory be honored for his many years of dedicated service to his nation, state, and community; and for his influence on young people through teaching and coaching.

A LEGISLATIVE COMMEMORATION,  Honoring the memory of former State     Representative Albert Schramm.

     WHEREAS,  few South Dakotans have served their state and community with more diligence and distinction than Albert Schramm who was appointed director of the West River Conservancy District and served four years in the South Dakota Legislature from 1987 to 1990 as a District 26 Representative during which time he served on both the Agriculture and Local Government Committees; and

     WHEREAS,  Albert was a fifty-year member and past president of the Winner Rotary, a member of the board of directors of Farmland Industries from 1965 to 1982, a life member of Trinity Lutheran Church in Winner, and president of the Rosebud Federal Credit Union from 1953 to 1985; and

     WHEREAS,  Albert's passing on January 30, 2000, at the age of eighty-four is mourned by his family, the members of his church and community, and a wide range of friends and acquaintances:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Seventy-fifth Legislature of the State of South Dakota, that Albert Schramm's memory be honored for his many accomplishments in public and private life.
