Dear Speaker Hunt and Members of the House:

I herewith return HB 1230 with the following recommendations as to STYLE and FORM.

House Bill 1230 is An Act to provide for the recovery of damages for checks, drafts, or orders not paid upon presentment.

On page 1, line 12 of the House Judiciary Engrossed bill, delete "of" and insert "that" in its place.

It appears that two differing terms are used in House Bill 1230 to refer to the same action. On page 2, Section 3 of the bill, the phrase "the time the check, draft, or order was made" is used at lines 7, 14, and 16. On page 1, line 5 and line 12; page 3, line 5 and page 3, line 22 of the bill, the term "issued" is used in a similar context instead of the term "made".


The South Dakota law on the Uniform Commercial Code § 57A-3-105, specifically refers to and defines the term "issue". There appears to be no definition of the term "made" in the UCC. Therefore, I recommend the term "made" as noted above be deleted and the term "issued" be inserted in its place.

I respectfully request you concur with my recommendation as to style and form.

     Rep. Cutler moved that when we adjourn today, we adjourn to convene at 1:00 P.M. on Tuesday, March 2nd, the 35th legislative day.

     The Committee on Legislative Procedure respectfully reports that HB 1138, 1189, 1198, 1213, 1225, 1254, 1296, 1299, and 1301 were delivered to his Excellency, the Governor, for his approval at 3:44 p.m., March 1, 1999.


Also MR. SPEAKER:

    The Committee on Legislative Procedure respectfully reports that the Office of Engrossing and Enrolling has carefully compared HB 1003, 1121, 1210, 1211, and 1221 and finds the same correctly enrolled.

     HB 1003: FOR AN ACT ENTITLED, An Act to  provide for the recovery of certain expenses in an action brought to court by any governmental subdivision relative to the assessment of property.

     HB 1121: FOR AN ACT ENTITLED, An Act to  provide health insurance coverage for diabetes supplies, equipment, and self-management training and education.

     HB 1210: FOR AN ACT ENTITLED, An Act to  provide a time to appeal notice of termination to a school board and to conduct a hearing thereon.

     HB 1211: FOR AN ACT ENTITLED, An Act to  extend the time for filing of the record in certain school appeals.

     HB 1221: FOR AN ACT ENTITLED, An Act to  require that certain persons having contact with pupils in school have a certification of health.

     SB 49: FOR AN ACT ENTITLED, An Act to  repeal the subsequent injury fund.

     SB 65: FOR AN ACT ENTITLED, An Act to  codify the legislation passed in 1998.

     SB 128: FOR AN ACT ENTITLED, An Act to  criminalize the possession of certain contraband in juvenile correctional facilities and the delivery of certain contraband to juvenile correctional facilities.

     SB 249: FOR AN ACT ENTITLED, An Act to  allow a special fireworks sale period at the turn of the millennium.
