     The Senate convened at 10:30 a.m., pursuant to adjournment, the President presiding.

     The prayer was offered by the Chaplain, Pastor Edwin Brown, followed by the Pledge of Allegiance led by Senate page Holly Casanova.

A CONCURRENT RESOLUTION,  Encouraging the resolution of all unresolved aspects of the     Dakota, Minnesota, and Eastern's proposed expansion.

     WHEREAS,  the Dakota, Minnesota, and Eastern Railroad has filed an application to build an extension onto its existing line and rebuild much of its existing line throughout South Dakota and such a project will provide a first class railroad infrastructure for the state; and

     WHEREAS,  the project has received strong support from agriculture groups, shippers, employees, a majority of the counties, and the cities through which it operates, and has also received strong support from the Governor; and

     WHEREAS,  there are legitimate issues of concern for many landowners and some of the communities along the route of the DM & E that have yet to be resolved and which remain under active discussion; and

     WHEREAS,  the $1.4 billion DM & E project is one of the most important capital infrastructure projects in the state's history and would provide a far better transportation system for South Dakota agriculture, timber, cement, clay, and other products; and

     WHEREAS,  the project would create many additional jobs for the people of South Dakota and also provide millions of dollars of additional tax revenue:

     NOW, THEREFORE, BE IT RESOLVED,  by the Senate of the Seventy-fourth Legislature of the State of South Dakota, the House of Representatives concurring therein, that the South Dakota Legislature acknowledges that this is a major entrepreneurial initiative and it is hopeful and expects that all remaining issues will be resolved in a reasonable and responsible manner by all the parties; and

     BE IT FURTHER RESOLVED,  that it is the Legislature's desire to encourage the successful completion of the project based on reasonable terms and all persons should understand that any and all action taken by the Legislature with respect to any law, policy, or funding is based upon a desire to assist in the proper, orderly, and fair completion of the project; and

     BE IT FURTHER RESOLVED,  that the Legislature appreciates all outreach efforts to bring about a speedy, proper, fair, and successful conclusion to the DM & E rebuilding project.

     On page 10 , line 10 of the House engrossed bill , delete " $148,777,289 " and insert " $150,662,032 " .

     On page 10 , line 10 , delete " $800,000 " and insert " $1,330,449 " .

Adjust all totals accordingly.

     On page 31 , after line 21 , insert:

"     Section 36. $530,449 other funds appropriated to the Division of Medical Services within the Department of Social Services are Youth-at-risk trust fund earnings to be spent on the Children's Health Insurance Program. "
