    BE IT REMEMBERED, That on the thirteenth day of January, A.D., one thousand nine hundred ninety-eight, at the hour of twelve o'clock meridian, being the date and hour fixed by the Constitution of the State of South Dakota for the convening of the Legislature, the Seventy- third regular session of the Senate of the State of South Dakota was called to order by Lieutenant Governor Carole Hillard in the Senate Chamber in the Capitol, in the City of Pierre, the seat of our government.

    The following prayer was offered by the Chaplain, Pastor Roger Easland, Congregational United Church of Christ, Pierre:

    We pray to You, Lord God all powerful, all knowing, all present, all graceful: When we recognize You working in our midst, in our structures, in the very marrow of our bones, You cause us to be changed, redirected and energized. Grant us the wisdom, courage and will to put into practice the truth You are revealing to us each day through the Living Word.

    In the Name of the One who walked with our same flesh, and who is One with the Father and who lives in us by God the Holy Spirit, Jesus Christ. Amen.

    Sen. Rounds moved that a committee of three on the part of the Senate be appointed to meet with a like committee on the part of the House relative to the Joint Rules for the two houses for the Seventy-third Legislative session.

    Sen. Rounds moved that a committee of three on the part of the Senate be appointed to meet with a like committee on the part of the House to make arrangements for legislative days for the members, officers, and employees of the Senate and the House for the Seventy-third Legislative Session.

    Sen. Rounds moved that a committee of three on the part of the Senate be appointed to meet with a like committee on the part of the House to fix the compensation of the elective and appointive officers and employees of the House and Senate for the Seventy-third Legislative

Session pursuant to SDCL 2-5-8, with the full power to act, and that such compensation schedule be filed with the Director of the Legislative Research Council and the State Auditor.

    Which motion prevailed and the President appointed as such committee Sens. Halverson, Rounds, and Hunhoff.

    Sen. Rounds moved that a committee of three on the part of the Senate be appointed to meet with a like committee on the part of the House to confer with the Director of the Legislative Research Council in regard to making arrangements for the distribution of the official directory, Senate and House journals and bills, and other legislative printing for the two Houses and the state offices, with the full power to act.

    Which motion prevailed and the President appointed as such committee Sens. Jim Dunn, Everist, and Rebecca Dunn.

    Sen. Rounds moved that a committee of three on the part of the Senate be appointed to meet with a like committee on the part of the House to select chaplains for the Seventy-third Legislative Session.

    Sen. Rounds moved that a committee of three on the part of the Senate be appointed to meet with a like committee on the part of the House to arrange for a memorial recognition of deceased former members of the Senate and House.

A CONCURRENT RESOLUTION,  Supporting and encouraging negotiations concerning the     mitigation of wildlife habitats on the Pick-Sloan reservoirs.

     WHEREAS,  the construction and impoundment of the Missouri River reservoirs inundated thousands of acres of state, tribal, and private lands in South Dakota; and

     WHEREAS,  the resulting reservoirs and take lands on the perimeters of these reservoirs constitute an outstanding fish and wildlife habitat and an outstanding natural resource for hunting and fishing; and

     WHEREAS,  important jurisdictional and mitigation questions have retarded the development and use of these natural resources by state, tribes, and private enterprise; and

     WHEREAS,  the State of South Dakota is currently negotiating with the tribes, in cooperation with the Corps of Engineers and the South Dakota Congressional delegation, for a comprehensive resolution of the issues concerning the use and management of this resource; and

     WHEREAS,  tremendous benefits, supported by federal mitigation payments, could accompany the successful completion of these negotiations:

     NOW, THEREFORE, BE IT RESOLVED,  by the Senate of the Seventy-third Legislature of the State of South Dakota, the House of Representatives concurring therein, that all parties to the negotiations for the mitigation of wildlife habitat on the Pick-Sloan reservoirs be congratulated for their efforts and foresight and be encouraged to continue their efforts to reach an agreement that would be in the interests of all parties and that would secure an invaluable and continuing natural resource to all citizens of South Dakota.

     Was read the first time and referred to the Committee on Agriculture and Natural Resources.

Cutler, Gabriel, and Haley as a committee of three on the part of the House to meet with a like committee on the part of the Senate to arrange for legislative days for members, officers, and employees for the Seventy-third Legislative Session.

    I have the honor to inform your honorable body that the House has appointed Reps. Hagg, Gabriel, and Haley as a committee of three on the part of the House to meet with a like committee on the part of the Senate to fix the compensation of the elective and appointive officers and employees of the House and Senate for the Seventy-third Legislative Session, pursuant to SDCL 2-5-8, with the full power to act and that such compensation schedule be filed with the Director of the Legislative Research Council and the State Auditor.

Also MADAM PRESIDENT:

    I have the honor to inform your honorable body that the House has appointed Reps. Cutler, Hunt, and Lucas as a committee of three on the part of the House to meet with a like committee on the part of the Senate to confer with the Director of the Legislative Research Council in regard to making arrangements for the distribution of the official directory, House and Senate journals and bills, and other legislative printing for the two Houses and the state offices with full power to act.

Also MADAM PRESIDENT:

    I have the honor to inform your honorable body that the House has appointed Reps. Fiegen, Monroe, and Cerny as a committee of three on the part of the House to meet with a like committee on the part of the Senate to secure chaplains for the Seventy-third Legislative Session.


Also MADAM PRESIDENT:

    I have the honor to inform your honorable body that the House has appointed Reps. Putnam, Fitzgerald, and Cerny as a committee of three on the part of the House to meet with a like committee on the part of the Senate to arrange for a memorial recognition of deceased former members of the House and Senate.

    I have the honor to inform your honorable body that the House has adopted the report of the Joint-Select Committee for the purpose of arranging a Joint Session of the two Houses to receive the message of the Governor.

JOINT SESSION

    Pursuant to the report of the Joint-Select Committee, the Senate convened with the House of Representatives in the House Chamber for the purpose of receiving a message from the Governor, William J. Janklow. The President of the Senate, Carole Hillard, presiding.

    The following prayer was delivered by Pastor David Zellmer, Lutheran Memorial Church, Pierre, South Dakota:

    O God of all creation as we have opened the 73rd legislative sesssion, we ask Your blessing upon this joint gathering. We lift up in prayer our Governor, Lt. Governor, our Representatives and Senators and all those who hold public office whether it be elected or appointed. We pray that Your Spirit will guide those set apart for service in their times of debate and as decisions are made. Bless them with the courage and the will to provide justice for all, through their work during this session.
