     The Senate convened at 2:00 p.m., pursuant to adjournment, the President presiding.

     The prayer was offered by the Chaplain, Larry Cass, followed by the Pledge of Allegiance led by Senate page Ryan Peterson.

     HCR 1006: A CONCURRENT RESOLUTION, Encouraging all South Dakota schools to place a sufficient number of Automated External Defibrillators (AEDs) in their facilities, at their athletic fields, and with their athletic staff, and to adopt a medical emergency response plan that includes AED use.

     Was read the first time, the President waived the referral to committee, and placed HCR 1006 on the calendar of Friday, February 13, the 22nd legislative day.

     SCR 3: A CONCURRENT RESOLUTION, Supporting a study of the potential creation of a Department of Veterans Affairs as a cabinet-level department.

     No person may file, register, or record any lien or liens pursuant to this chapter if the amount claimed in the lien or liens exceeds, singularly or in aggregate, the value of the labor, services, and material to which the person is lawfully entitled. Any person who knowingly violates the provisions of this section is guilty of offering a counterfeit lien for filing, registering, or recording and is punishable as prescribed in §  22-11-28."

COMMEMORATION

     SC 10  Introduced by:  Senator Hunhoff (Jean) and Representatives Hunhoff (Bernie) and Moser

         A LEGISLATIVE COMMEMORATION,  Honoring Ken Schaefer of Yankton for his dedication to student athletes and for being selected as 2009 Assistant Coach of the Year.

     WHEREAS,  Ken Schaefer has proven his commitment to teaching and coaching the student athletes of Yankton High School and Yankton Middle School for the past thirty-five years; and

     WHEREAS,  Ken has demonstrated exceptional character in sharing his passion for athletics and his dedication to excellence in three sports: football, wrestling, and track; and

     WHEREAS,  Ken lead the Yankton High School Bucks wrestling team as head coach for nineteen years, and coached the Bucks to two consecutive Eastern South Dakota Conference titles and the team's only state title in 1986; and

     WHEREAS,  Ken has earned the respect and recognition of his community and his peers in the South Dakota High School Coaches Association who selected him to be the 2009 Assistant Coach of the Year:

     NOW, THEREFORE, BE IT COMMEMORATED,  by the Eighty-fourth Legislature of the State of South Dakota, that Ken Schaefer is honored for his dedication to student athletes, his commitment to his community, and his selection as 2009 Assistant Coach of the Year.
