AMENDMENT 83F FOR THE SENATE COMMERCE AND ENERGY BILL

An Act to establish meetings to review certain electric systems.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added:

49-34A-116. Electric utility meetings--Review of systems--Notice and filings.

Annually, on or about the first Monday of during the month of April or May, all electric utilities serving in areas within and adjacent to a municipality that owns and operates its own electric utility shall, in a public meeting, engage in a review of electric systems, including any existing facilities and planned facilities or improvements in service areas within and adjacent to the municipality. The review does not require any electric utility to provide information that involves critical infrastructure under federal standards, that would be exempt from disclosure under subdivision 1-27-1.5(8), or that would require discussing marketing or pricing strategies when public discussion may be harmful to the competitive position of the utility. The governing body of the municipality shall provide notice pursuant to § 1-25-1.1 for the meeting and shall record the meeting. Upon completion of the meeting, the governing body of the municipality shall maintain recordings and minutes. No electric utility may be required to attend more than one meeting on the same day unless the electric utility consents.
