An Act to provide for restore the inspection authority of certain the Department of Environment and Natural Resources to regulate public swimming pools and beaches places.

Be it enacted by the Legislature of the State of South Dakota:

Section 1. That a NEW SECTION be added:

34A-2-12.2. Regulation of public swimming places--Violation.

The Department of Environment and Natural Resources shall promulgate rules pursuant to chapter 1-26 regulating a public swimming place. A violation of rules promulgated pursuant to this section is subject to § 34A-2-75.

The rules promulgated under this section do not apply to a swimming pool regulated by the Department of Health, a swimming pool in a condominium project established under chapter 43-15A, or a swimming pool in an apartment complex.
